前言

Preface

以习近平新时代中国特色社会主义思想为指导,为贯彻《中共中央国务院关于建立国土空间规划体系并监督实施的若干意见》(中发〔201918号),落实《海南自由贸易港建设总体方案》,改革完善国土空间规划体系,适应海南自由贸易港建设需求,充分衔接国土空间总体规划,更好指导本省城镇开发边界内的各类建设活动,海南省自然资源和规划厅根据相关法律法规、政策和技术标准,在总结实践经验、借鉴优秀成果、广泛听取意见的基础上,研究制定了《海南省城镇开发边界内控制性详细规划编制技术规定(试行)》,主要内容包括5部分:总则、编制前期研究支撑内容、单元规划编制内容、地块规划编制内容、附则。

Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, the Department of Natural Resources and Planning of Hainan Province has studied and prepared theTechnical Regulations for the Formulation of Regulatory Detailed Planning within the Scope of Urban Development in Hainan Province (Trial)according to relevant laws, regulations, policies and technical standards, on the basis of summing up practical experience, learning from excellent achievements and widely listening to opinions in order to implement the Several Opinions of the CPC Central Committee of the Communist Party of China and the State Council on Establishing a Territorial and Spatial Planning System and Supervising Its Implementation(General Office of the CPC Central Committee - Regulation - 2019-No. 18) and the MasterPlan for thethe Hainan Free Trade Port, reform and improve the territorial and spatial planning system, meet the needs for the construction of the Hainan Free Trade Port, fully integrate the master territorial and spatial plan, and better guide various construction activities within the scope of urban development of the province. The main contents include five parts: general provisions, compilation of preliminary research support content, unit planning compilation content, plot planning compilation content, and supplementary provisions.

本技术规定主要起草单位:海南省自然资源和规划厅(吴刚、胡木春、金洋、许译文、郑玉洁)。

  1. 总则Chapter I General Provisions

  1. (目的和依据)

Article 1 (Purpose and Basis)

为贯彻落实《中共中央国务院关于建立国土空间规划体系并监督实施的若干意见》,保障自由贸易港建设需求,进一步建立健全我省国土空间规划体系,规范城镇开发边界内控制性详细规划编制,加强城镇规划管理,结合我省实际,制定本规定。

The regulations are formulated according to the actual conditions of Hainan Province in order to implement the Several Opinions of the CPC Central Committee and the State Council on Establishing a Territorial and Spatial Planning System and Supervising Its Implementation, ensure the construction needs of the Hainan Free Trade Port, further establish and improve the territorial and spatial planning system of our province, regulate the compilation of theregulatory detailed plan within the scope of urban development, and strengthen the management of urban planning.  

  1. (总体要求)

Article 2 (General Requirements)

编制控制性详细规划应当遵循政府组织、专家领衔、部门合作、公众参与、科学决策的原则。

The compilation of theregulatory detailed plan shall follow the principles of government organizational structure, expert leadership, departmental cooperation, public participation, and scientific decision-making.

控制性详细规划编制应当综合考虑地域特征、资源条件、环境保护、人文因素、公共安全、土地权属、公众意愿和经济社会发展需要,统筹利用地上地下空间,保障社会公共利益,保护城镇基本生态与历史风貌,体现生态文明导向、高质量发展理念和自由贸易港发展建设要求,符合上位国土空间规划,衔接各类专项规划,确保“一张蓝图绘到底”。

The compilation of theregulatory detailed plan shall comprehensively consider geographical characteristics, resource conditions, environmental protection, human factors, public security, land ownership, public wishes and the needs of economic and social development, make overall use of aboveground and underground space, safeguard social and public interests, and protect the basic ecology and historical features of cities and towns, reflects the orientation of ecological civilization, the concept of high-quality development and the development and construction requirements of the Hainan Free Trade Port, comply with the upper territorial and spatial planning, and connect various special plans to ensure that "one blueprint is drawn to the end".

  1. (编制范围)

Article 3 (Scope of Compilation)

控制性详细规划编制范围为城镇开发边界内全部国土空间。

The compilation scope of the regulatory detailed plan is all the territorial space within the scope of urban development.

相邻城镇开发边界的区域可合并范围后统一组织编制控制性详细规划。

For the areas adjacent to the development scope of cities and towns, the regulatory detailed plan shall be uniformly organized and prepared after they are merged.

  1. (分层编制管理)

Article 4 (Hierarchical Compilation Management)

控制性详细规划包含单元规划和地块规划。

Regulatory detailed planning includes unit planning and plot planning.

  1. (控制单元)

Article 5 (Control Unit)

组织控制性详细规划编制的单位应统筹考虑行政区划、自然地理格局、道路交通、空间结构、设施服务半径、用地功能联系等要素,以及控制区域的功能属性、产城融合、新旧城区、近远期要求等因素,合理确定城镇开发边界内建设用地布局,将其划分成若干个规划控制单元,作为落实上位规划传导内容、衔接具体地块实施安排的基本单位。

The unit that organizes the compilation of the regulatory detailed plan shall take overall consideration of the factors such as administrative divisions, natural geographical pattern, road traffic, spatial structure, facility service radius and land-use function connection, as well as functional attributes of the controlled area, integration of industry and city, old and new urban areas, and short-term and long-term requirements to reasonably determine the layout of construction land within the scope of urban development, and divide it into several planning control units, which are the basic units for implementing the transmission content of the master planning and connecting the implementation arrangements of specific plots.

控制单元原则上以1-3平方公里左右为宜,各地可结合实际适当扩大或缩小划定单元范围。

In principle, the control unit shall be about 1 to 3 square kilometers. Local areas may expand or narrow the demarcated unit scope according to actual conditions.

  1. (用地性质)

Article 6 (Land Usage)

控制性详细规划用地性质应参照《国土空间调查、规划、用途管制用地用海分类指南(试行)》确定。

The usage of land for theregulatory detailed plan shall be determined with reference to theGuidelines for Land and Sea Classification of Land and Space Investigation, Planning and Use Control (Trial).

  1. (规划成果)

Article 7 (Planning Results)

控制性详细规划成果应包括文本、管控图则和附件。

The results of theregulatory detailed plan shall include texts, control plans and attachments.

管控图则包括单元图则和地块图则。单元规划应以控制单元为最小单位编制单元图则;地块规划应以一个或多个地块为最小单位编制地块图则;重点地区还可根据城市设计或专项研究等内容编制附加图则。

Control plans include unit plans and plot plans. Unit planning shall take the control unit as the minimum unit to prepare the unit plan; plot planning shall take one or more plots as the minimum unit to prepare the plot plan; additional plans may also be prepared in key areas based on urban design or special research.

规划文本应当明确图则所表示各类内容的控制要求,还应明确引导内容的执行规则。

Planning texts shall specify the control requirements for various contents indicated in the plan, and the implementation rules guiding the contents.

附件包括规划图集、说明性文件、基础资料汇编、审批文件与公众参与意见等内容。(参见《附表1:控制性详细规划成果构成一览表》)

Annexes include planning atlases, explanatory documents, compilation of basic documents, approval documents and opinions of public participation. (See "Schedule 1: List of the Result Composition of the Regulatory Detailed Plan")

  1. (数据库管理)

Article 8 (Database Management)

编制控制性详细规划时应当同步建立规划数据成果。数据成果应当符合城镇开发边界内控制性详细规划数据库标准。

The planning data results shall be established simultaneously when the regulatory detailed plan is prepared. The data results shall conform to the database standards of the regulatory detailed plan within the scope of urban development.

  1. 编制前期研究支撑内容Chapter II Compilation of Supporting Contents of Preliminary Research

  1. (总体研究内容)

Article 9 (Overall Research Contents)

控制性详细规划编制前期应首先研究并确定下列内容:

The following contents shall be studied and determined at the early stage of the compilation of the regulatory detailed plan:

(一)现行规划实施评估:对规划范围内现行控制性详细规划的实施执行情况进行评估,重点评估规划中强制性内容实施执行情况等主要内容。

(1) Evaluation on the implementation of the current plan: We shall evaluate the implementation of the current regulatory detailed plan within the planning scope, and focus on evaluating the implementation of mandatory contents in the planand more.

(二)目标策略:结合上位规划确定的发展目标、城镇性质和职能,衔接相关专项规划,统筹考虑地区发展条件,明确规划功能定位、发展目标和产业发展策略。

(2) Target strategy: We shall connect the relevant special plans in combination with development goals, usage and functions of cities and towns determined by the master plan, take overall consideration of regional development conditions, and specify the planning function positioning, development goals and industrial development strategies.

(三)总体规模:根据上位规划和发展现状,合理确定服务管理人口,分析人口类型及相应的供给标准,结合规划期内建设用地情况,明确总建筑面积。

(3) Overall scale: We shall reasonably determine the service management population according to the master plan and development status, analyze the population type and corresponding supply standards, and specify the total construction area in combination with the construction land-use during the planning period.

(四)空间结构:结合上位规划确定的总体空间结构和约束性指标,根据山水格局、资源条件、公共安全及建设情况等因素,明确规划空间结构,细化建设用地边界和公共蓝绿开敞空间,划分控制单元。

(4) Spatial structure: We shall specify the planned spatial structure, refine the boundary of construction land and public blue and green open spaces, and divide control units in combination with the overall spatial structure and binding indicators determined by the master plan, according to the factors such as landscape pattern, resource conditions, public security, and construction.

(五)用地布局:结合规划空间结构,在用地评价和用地选择的基础上,根据地块的特点和要求,对各类功能的用地和空间进行统一安排。

(5) Land-use layout: We shall uniformly arrange the land and space for various functions based on land-use evaluation and land selection, in combination with the planned space structure according to the characteristics and requirements of the plot.  

  1. (专项统筹内容)

Article 10 (Content of Special Overall Planning)

控制性详细规划编制前期应对规划范围内的以下内容进行专项统筹研究:

In the early stage of the compilation of the regulatory detailed plan, special overall research shall be carried out on the following contents within the planning scope:

(一)居住用地控制。根据总体人口规模、建设用地规模以及环境承载能力,合理确定居住用地比例,明确居住用地布局和规模。

(1) Control of residential land. We shall reasonably determine the proportion of residential land, and specify the layout and scale of residential land according to the overall population scale, construction land scale and environmental carrying capacity.

(二)公共服务设施控制。根据服务管理人口和居住社区分布,结合设施服务半径和生活圈居住区配套要求等,衔接相关专项规划成果,明确公共管理和公共服务设施及生活性商业服务业设施(重点指农贸市场)的分级、布局和规模。

(2) Control of public service facilities. We shall connect the results of relevant special plans, and specify the classification, layout and scale of public management and public service facilities and living commercial service facilities (farmers' markets in particular) in combination with the service radius of facilities and the supporting requirements of residential areas in the living circle according to the distribution of service management population and residential communities.

(三)绿地与开敞空间系统控制。结合绿地系统、游憩体系、绿道体系、视线通廊等内容,统筹联系城镇开发边界内特别用途区等非建设用地,提出相应的管制措施和开敞空间系统性要求,落实生态环境保护、休闲游憩空间建设等相关要求。

(3) Control of green space and open space system. We shall coordinate and contact non-construction land such as special-purpose areas within the scope of urban development, put forward corresponding control measures and systematic requirements for open space, and implement relevant requirements for ecological environment protection and leisure space construction.

(四)公用设施控制。根据服务管理人口和总建筑面积,落实上位规划,衔接相关专项规划,明确公用设施用地和管线布局,提出各类市政设施的规划控制要求。

(4) Control of public facilities. We shall implement the master plan, connect the relevant special plans, specify the land and pipeline layout of public facilities, and put forward the planning control requirements for various municipal facilities according to the service management population and total construction.

(五)综合交通系统控制。规划统筹航空、轨道、公路、港口等各类交通组织方式,确定城市道路分级和各级道路的红线宽度,明确各类交通设施场站的位置、数量、规模和要求,合理提出绿色交通和慢行优先措施。

(5) Control of integrated transport system. We shall plan and coordinate various ways of transport organization such as aviation, rail, highway and port, determine the classification of urban roads and the red line width of roads at all levels, specify the location, quantity, scale and requirements of various transport facilities and stations, and reasonably put forward priority measures for green transport and slow traffic.

(六)历史文化保护。存在历史文化保护要素的区域,应明确历史文化街区、历史建筑和各级文物保护单位等核心保护范围和建设控制地带,明确保护措施,结合功能引导和城市设计等内容强化历史文化保护与传承。

(6) Historical and cultural protection. For areas where there are elements of historical and cultural preservation, we shall define core protection scope and construction control zones of historical and cultural blocks, historical buildings and cultural relics protection units at all levels, specify protection measures, and combine functional guidance and urban design to strengthen historical and cultural protection and inheritance.

(七)地下空间利用。有集中利用地下空间条件的区域,应明确地下空间发展原则、目标规模,协调地上地下空间的关系,促进地下空间资源综合利用。

(7) Utilization of underground space. For areas where there are conditions for concentrated use of underground space, we shall specify the principles and target scale of underground space development, coordinate the relationship between aboveground and underground space, and promote the comprehensive utilization of underground space resources.

(八)生态环境保护。控制性详细规划编制中应同步编制环境影响篇章或说明,对规划实施后可能造成的环境影响作出分析、预测和评价,提出减缓对策和措施。结合上位规划和相关专项规划确定生态系统格局,落实生态保护目标和任务;明确绿色建筑、新能源利用等方面的要求。

(8) Ecological and environmental protection. In the compilation of the regulatory detailed plan, we shall simultaneously compile environmental impact chapters or descriptions, analyze, forecast and evaluate the possible environmental impact after the implementation of the plan, and put forward mitigation measures. We shall determine the ecosystem pattern and implement the objectives and tasks of ecological protection in combination with the master plan and relevant special plans, and specify the requirements for green buildings and new energy utilization.

(九)综合防灾系统控制。结合对灾害风险的评估,提出应对洪、涝、台风、地震等各类灾害的措施,明确各类防灾减灾设施建设的布局、规模等,提出建设韧性城市的各项要求。

(9) Integrated disaster prevention system control. We shall put forward measures to deal with various disasters such as flood, water-logging, typhoon and earthquake in combination with the assessment of disaster risks, specify the layout and scale of the construction of various facilities for disaster prevention and mitigation, and put forward various requirements for building resilient cities.

(十)其他内容统筹。根据规划区域实际情况,可增加其他认为需要统筹的研究内容。

(10) Coordination of other contents. According to the actual situation of planned areas, other research contents that need to be coordinated may be added.

  1. (城市设计)

Article 11 (Urban Design)

控制性详细规划应结合海南气候环境特征和地域文化特色,加强规划范围内城市设计及对风貌管控的研究。

In the regulatory detailed plan, we shall combine the climate and environmental characteristics and regional cultural characteristics of Hainan Province, and strengthen the research on urban design and style and features control within the planning scope.

第三章 单元规划编制内容Chapter III Contents of Unit Plan Compilation

  1. (单元规划内容)

Article 12 (Contents of the Unit Plan)

单元规划应在研究支撑内容的基础上明确发展目标和性质定位、控制单元范围及主导功能、人口规模、用地布局、建设用地规模及居住用地规模、总建筑面积及居住建筑面积,以及公共服务设施、公用设施、交通设施、应急安全设施、道路路网密度、绿地与开敞空间、建筑高度等规划布局和控制要求。

The unit plan shall specify the development goals and usage positioning, the control unit scope and dominant functions, population scale, land layout, construction land scale and residential land scale, total construction area and residential construction area, and control requirements for planning layout and control such as public service facilities, public facilities, transport facilities, emergency safety facilities, road network density, green space, open space, and building height.

单元规划内容应包括“限制—引导”两类。限制内容在单元规划中明确规划管控要求,引导内容可在地块规划中细化落实。

The contents of the unit plan shall include types of "restriction and guidance". The restriction contents in the unit plan shall clearly define requirements for planning control, and the guidance contents may be detailed and implemented in plot planning.

  1. (单元图则表达形式及内容)

Article 13 (Expression Form and Contents of the Unit Plan)

单元图则采用图示和图表文字两种表达形式。图示中以实线表达限制边界,以虚线表达引导边界,以不同颜色和特定符号区分用地性质和规划控制线等,并标注控制单元的范围和各地块建筑高度控制要求。

The unit plan is expressed in two forms: diagrams and charts and texts. In the diagram, the limit boundary is expressed with solid lines, and the guiding boundary is expressed by dashed lines. The land usage and planning control lines are distinguished by different colors and specific symbols, and the scope of the control unit and requirements for building height control of each plot are marked.

图表文字中通过标注或描述表达控制指标、控制规则等内容,包括表达单元主导功能定位、人口规模、总用地规模、总建筑面积、道路密度等。

Contents such as control indicators and control rules are indicated or described in charts and texts, including the dominant function positioning of expression unit, population size, total land scale, total construction area, road density, etc.

  1. (居住用地控制)

Article 14 (Control of Residential Land)

单元规划应明确居住用地的管控内容。

The unit plan shall specify the control contents of residential land.

本规定所称居住用地,包括各类居住用地和按照《城市居住区规划设计标准》应当在居住用地内配备的生活服务设施用地。居住用地的规划用地性质应确定至二级类。

The residential land mentioned in these Regulations includes various types of residential land and land for living service facilities that shall be equipped in residential land in accordance with theStandards for Planning and Design of Urban Residential Areas. The usage of planned land for residential use shall be determined as Class II.

居住用地的控制单元总用地面积、总建筑面积、建筑高度和地块绿地率为限制内容,用地边界为引导内容。

The total land area, total construction area, building height, and plot greening rate of the control unit of residential land are restricted contents, and the land boundary is the guiding content.

单元图则中以图示形式表达居住用地的位置和建筑高度,以图表文字表达控制单元的居住用地总用地面积、总建筑面积和地块绿地率等。

In the unit plan, the location and building height of residential land shall be expressed in the form of diagrams, and the total residential land area, total construction area and plot greening rate of the control unit shall be expressed in charts and texts.

  1. (核心服务用地控制)

Article 15 (Control of Land-Use for Core Services)

单元规划应明确核心服务用地的管控内容。

The unit plan shall specify the management and control content of the land for core services.

本规定所称核心服务用地,包括按照生活圈标准配置的公共管理与公共服务用地、特殊用地、绿地与开敞空间用地以及规划需要控制的生活性商业服务业设施用地(重点指作为零售商业用地的农贸市场)。核心服务用地的规划用地性质应确定至二级类,生活性商业服务业设施用地应确定至三级类,并在文本中明确可兼容建设的内容。

The land for core services mentioned in these Regulations includes the land for public management and public services, special land, green space and open space configured according to the living circle standards, as well as the land for living commercial service facilities that need to be controlled in the planning (the land used for retail business of farmers’ market in particular). The usage of the planned land for core services shall be determined as Class II. The land for living commercial service facilities shall be determined as Class III, and the contents of compatible construction shall be specified in the text.

核心服务用地的用地性质、用地边界为限制内容。

The usage and boundary of the land for core services are restriction contents.

单元图则中应以图示形式表达各类核心服务用地的用地性质和用地边界,以图表文字形式表达各地块的用地面积、容积率和可兼容建设的内容等。

In the unit plan, the usage and boundary of the land for various core services shall be expressed in the form of diagrams, and the land-use area, plot ratio and compatible construction contents of each plot shall be expressed in charts and texts.

  1. (公用设施用地控制)

Article 16 (Control of Land for Public Facilities)

单元规划应明确公用设施用地的管控内容。

The unit plan shall specify the management and control content of the land for public facilities.

本规定所称公用设施用地,包括供水、排水、供电、供燃气、供冷、通信、邮政、广播电视设施、环卫、消防等各类公用设施用地。公用设施用地的规划用地性质应确定至二级类,并在文本中明确可兼容建设的内容。加油加气充换电站属于公用设施营业网点用地,参照公用设施用地管理。

The land for public facilities mentioned in these Regulations includes land for water supply, drainage, power supply, gas supply, cooling, communications, postal services, radio and television facilities, sanitation, and fire fighting, etc. The usage of the planned land for public facilities shall be determined as Class II, and the compatible construction contents shall be specified in the text. Refueling, gas charging, battery charging and exchange stations belong to the land used by business outlets of public facilities, which shall be managed with reference to the land for public facilities.

公用设施用地的用地性质和用地边界为限制内容。

The usage and boundary of the land for public facilities are restriction contents.

单元图则中以图示形式表达各类公用设施用地的用地性质和用地边界,以图表文字形式表达各地块的用地面积、容积率、可兼容建设的内容等。

In the unit plan, the usage and boundary of the land for various public facilities shall be expressed in the form of diagrams, and the land-use area, plot ratio and compatible construction contents of each plot shall be expressed in charts and texts.

  1. (核心道路交通设施用地控制)

Article 17 (Control of Land for Core Road Transport Facilities)

单元规划应明确核心道路交通设施用地的管控内容。

The unit plan shall specify the management and control content of the land for core road transport facilities.

本规定所称核心道路交通设施用地,包括城市轨道交通和快速路用地、城市干路用地,以及对外交通场站用地、公共交通场站用地和社会停车场用地。核心道路交通设施用地的规划用地性质应确定至二级类(有三级类应当确定至三级类)。

The land for core road transport facilities mentioned in these Regulations includes land for urban rail transit and expressway, land for urban truck roads, and land for external traffic stations, public transport stations and social parking lots. The usage of the planned land for core road transport facilities shall be determined as Class II (It shall be determined as Class III if any).

(一)城市轨道交通和快速路用地、城市干路用地的控制内容仅包括用地性质和用地边界,均为限制内容。

(1) The control contents of land for urban rail transit, expressway and urban truck road land only include the usage and scope of the land,which are restriction contents.

单元图则中以图示形式采用实线表达城市轨道交通和快速路用地、城市干路用地和规划期内保留现状支路的用地性质和用地边界,采用虚线形式表达规划需要控制的支路用地边界。

In the unit plan, the land for urban rail transit and expressway, the land for urban trunk roads and the land usages and boundaries of the existing branch roads reserved during the planning period shall be expressed with solid lines, and the boundary of land for branch roads to be controlled in the planning shall be expressed with dotted lines.

(二)对外交通场站用地、公共交通场站用地的用地性质和用地边界为限制内容,地块容积率为引导内容。在不影响主体功能的前提下,对外交通场站用地和公共交通场站用地可混合利用以及地上、地下空间的复合利用。

(2) The usage and boundary of the land for external transport stations and public transport stations are restriction contents, and the plot ratio is guidance content. On the premise of not affecting the main functions, the land for external transport stations and public transport stations can be used in a mixed manner, as well as the combined use of aboveground and underground spaces.

单元图则中以图示形式表达交通枢纽用地、公共交通场站用地的用地性质和用地边界,以图表文字形式表达各地块的用地面积、容积率和可兼容建设的内容等。

In the unit plan, the usage and boundary of the land for external transport stations and public transport stations shall be expressed in the form of diagrams, and the land-use area, plot ratio and compatible construction contents of each plot shall be expressed in charts and texts.

(三)社会停车场用地的用地性质和用地边界为限制内容。

(3) The usage and boundary of the land for social parking lots are restriction contents.

Article 18 (Control of Land for Other Development Uses)

单元规划应明确其他发展用地的管控内容。

The unit plan shall specify the management and control content of land for other development uses.

本规定所称其他发展用地,指上述居住用地、核心服务用地、公用设施用地和核心道路交通设施用地之外的各类建设用地。其他发展用地的规划用地性质应确定至一级或二级类。单元规划应根据总体功能定位和产业类型,对其他发展用地的控制主导功能和用地类型提出相应指引和管控要求,向地块规划传导。

The land for other development uses mentioned in these Regulations refers to all types of land for construction other than the above-mentioned residential land, land for core services, public facilities, and core road transport facilities. The usage of land for other development uses shall be determined as Class I or Class II. The unitplan shall, based on the overall functional positioning and industrial type, put forward corresponding guidance and control requirements for the control dominant functions and land-use types of land for other development uses, and transfer them to plot planning.

其他发展用地的控制单元用地规模和总建筑面积、建筑高度为限制内容,用地性质为引导内容。

The land scale, total building area and building height of control units of land for other development uses are restriction contents, and the land usage is guidance content.

  1. (非建设用地控制)

单元规划应明确规划范围内非建设用地的管控内容。

The unit plan shall specify the management and control content of non-construction land within the planning scope.

本规定所称非建设用地,包括开发边界内的耕地、园地、林地、草地和湿地。非建设用地的规划用地性质应确定至一级或二级类。单元规划应落实上位规划要求,明确各类非建设用地的边界,可结合相关专项规划要求明确各类非建设用地的管控措施。

The non-construction land mentioned in these Regulations includes cultivated land, garden land, forest land, grassland and wetland within the development scope. The usage of planned non-construction land shall be determined as Class I or Class II. The unit plan shall implement the requirements of the master plan, define the boundaries of various types of non-construction land, and specify the management and control measures of various types of non-construction land in combination with relevant requirements for special planning.

非建设用地的用地性质和用地边界为限制内容。

The usage and boundary of non-construction land are restriction contents.

单元图则中以图示形式表达非建设用地的用地性质和用地边界。

In the unit plan, the usage and boundary of non-construction land shall be expressed in the form of diagrams.

  1. (单元规划城市设计)

Article 20 (Urban Design of Unit Plan)

单元规划城市设计主要包括以下内容:

The unit planning urban design mainly includes the following contents:

(一)根据气候特征、山水格局、文化气质、功能特点等明确风貌定位。

(1) The style and features positioning should be defined according to climate characteristics, landscape pattern, cultural temperament and functional characteristics.

(二)确定门户、标志性建(构)筑物(群)、重要节点、重要边界(界面)、重要廊道等内容。

(2) The contents such as portal, landmark building (structure) building (cluster), important node, important boundary (interface), important corridor, etc.

(三)明确提出建筑高度、风格、风貌、色彩以及其他认为必要控制内容的管控要求。

(3) The management and control requirements for building height, style, features, color and other necessary control contents shall be clearly put forward.

(四)划定城市设计重点地区,向地块规划传导。

第四章 地块规划编制内容Chapter IV Contents of Plot Plan Compilation

  1. (地块规划内容)

地块规划应细化落实单元规划的传导内容,明确地块各项控制内容和规划条件,作为实施建设项目的法定依据。

The plot plan shall be detailed to implement the transmission contents of the unit plan, specify the control contents and planning conditions of plot as the legal basis for the implementation of construction projects.

  1. (地块图则表达形式及内容)

Article 22 (Expression Forms and Contents of Plot Plan)

地块图则采用图示和图表文字两种表达形式。图示中以不同线型表达地块内各类边界及控制线;图表文字中通过标注或描述表达控制指标、控制规则等内容。

The plot plan is expressed in two forms: diagram and charts and texts. In the diagram, various boundaries and control lines shall be expressed with different line types, and the contents such as control indicators and control rules shall be expressed with annotations or descriptions in charts and texts.

地块图则以图示形式表达地块边界、建筑退线和机动车禁止开口线以及落实单元规划确定的控制线等;以图表文字形式表达地块用地性质、容积率、建筑高度、建筑密度、绿地率、建筑贴线率、各类配建设施要求和可兼容建设的内容等。

In the plot plan, the plot boundary, building setback restriction line, motor vehicle forbidden opening line, and the control line determined in the implementation of the unit plan shall be expressed in the form of diagrams, and the land usage, plot ratio, building height, building density, greening rate, building alignment rate, requirements for various supporting facilities and compatible construction contents of each plot shall be expressed in charts and texts.

  1. (地块用地性质)

地块规划应结合单元规划的要求和引导内容细化落实各地块的用地性质。

The plot plan shall refine and implement the land usage of each plot in combination with the requirements and guiding contents of the unit plan.

混合用地可采用土地混合利用和建筑复合使用方式。用地性质编号排在首位的为主要性质。

Mixed land can be used for mixed land uses and building composite uses. The main usage is the one with the number of land usage in the first place.

  1. (道路系统)

Article 24 (Road System)

地块规划应细化落实城市道路路网布局,划定支路用地红线,确定各级道路断面形式,为地上、地下工程管线和其他市政设施提供空间,提出绿色和慢行交通系统等相关内容的建议。

The plot plan shall be detailed to implement the layout of the urban road network, delineate red lines for branch roads, determine the form of road sections at all levels, provide space for aboveground and underground engineering pipelines and other municipal facilities, and put forward suggestions on contents related to green and slow traffic systems.

  1. (地块规划城市设计)

Article 25 (Urban Design of Plot Plan)

位于重点地区的地块,应落实城市设计管控要求,提出建筑形态、建筑界面、滨水岸线、景观设施、地下空间、建筑色彩等的管控要求,向地块建筑设计方案传导。

For plots located in key areas, we shall implement the management and control requirements for urban design, put forward the management and control requirements for architectural form, architectural interface, waterfront, landscape facilities, underground space and architectural color, and transfer them the architectural design scheme of the plot.

鼓励其他地区的地块按照建设需求明确城市设计内容。

We shall encourage plots in other areas to specify urban design contents according to construction requirements.

  1. (土地使用和建筑规划管理通则)

Article 26 (General Rules for Land-Use and Building Planning Management)

地块规划应明确土地使用和建筑规划管理通则,包括各种使用性质用地适建要求,建筑间距规定,建筑物后退道路红线距离规定,相邻地段的建筑规定,容积率奖励和补偿规定,市政公用设施、交通设施的配置和管理要求,建设开发时序,以及有关名词解释等其他有关通用的规定。

The plot plan shall specify the general rules of land-use and building planning management, including the requirements for suitable construction of various types of land, regulations on building spacing, regulations on the distance of road red line of building setback restrictions, regulations on buildings in adjacent sections, regulations on plot ratio incentives and compensation, and the configuration and management requirements for municipal public facilities and traffic facilities, as well as other relevant general regulations on timing sequence of construction and development, and the interpretation of relevant terms.

第五章 附则Chapter V Supplementary Provisions

  1. 本办法由海南省自然资源和规划厅负责解释。

Article 27 These Regulations shall be interpreted by the Department of Natural Resources and Planning of Hainan Province.  

  1. 本办法自印发之日起30日后施行。

Article 28 These Regulations shall come into force 30 days after the date of issuance.

结合规划空间结构,在用地评价和用地选择的基础上,根据地块的特点和要求,对各类功能的用地和空间进行统一安排。

We shall uniformly arrange the land and space for various functions based on land-use evaluation and land selection, in combination with the planned space structure according to the characteristics and requirements of the plot.  

居住用地布局

根据总体人口规模、建设用地规模以及环境承载能力,合理确定居住用地比例,明确居住用地布局和规模。

We shall reasonably determine the proportion of residential land, and specify the layout and scale of residential land according to the overall population scale, construction land scale and environmental carrying capacity.

公共服务设施体系

Public service facilities system

根据服务管理人口和居住社区分布,结合设施服务半径和生活圈居住区配套要求等,衔接相关专项规划成果,明确公共管理和公共服务设施及生活性商业服务业设施(重点指农贸市场和加油加气充换电站)的分级、布局和规模。

We shall connect the results of relevant special plans, and specify the classification, layout and scale of public management and public service facilities and living commercial service facilities (farmers' markets and refueling, gas charging, battery charging and exchange stations in particular) in combination with the service radius of facilities and the supporting requirements of residential areas in the living circle according to the distribution of service management population and residential communities.

绿地与开敞空间系统

Green and open space system

结合绿地系统、游憩体系、绿道体系、视线通廊等内容,统筹联系城镇开发边界内特别用途区等非建设用地,提出相应的管制措施和开敞空间系统性要求,落实生态环境保护、休闲游憩空间建设等相关要求。

We shall coordinate and contact non-construction land such as special-purpose areas within the scope of urban development, put forward corresponding control measures and systematic requirements for open space, and implement relevant requirements for ecological environment protection and leisure space construction.

公用设施体系

Public facilities system

根据服务管理人口和总建筑面积,落实上位规划,衔接相关专项规划,明确各类市政公用设施用地和管线布局,提出各类市政设施的规划控制要求。

We shall implement the master plan, connect the relevant special plans, specify the land and pipeline layout of public facilities, and put forward the planning control requirements for various municipal facilities according to the service management population and total construction.

综合交通体系

Integrated transport system

规划统筹航空、轨道、公路、港口等各类交通组织方式,确定城市道路分级和各级道路的红线宽度,明确各类交通设施场站的位置、数量、规模和要求,合理提出绿色交通和慢行优先措施。

We shall plan and coordinate various ways of transport organization such as aviation, rail, highway and port, determine the classification of urban roads and the red line width of roads at all levels, specify the location, quantity, scale and requirements of various transport facilities and stations, and reasonably put forward  priority measures for green transport and slow traffic.

历史文化保护

Historical and cultural protection

存在历史文化保护要素的区域,应明确历史文化街区、历史建筑和各级文物保护单位等核心保护范围和建设控制地带,明确保护措施,结合功能引导和城市设计等内容强化历史文化保护与传承。

For areas where there are elements of historical and cultural preservation, we shall define core protection scope and construction control zones of historical and cultural blocks, historical buildings and cultural relics protection units at all levels, specify protection measures, and combine functional guidance and urban design to strengthen historical and cultural protection and inheritance.

地下空间利用

Utilization of underground space

有集中利用地下空间条件的区域,应明确地下空间发展原则、目标规模,协调地上地下空间的关系,促进地下空间资源综合利用。

For areas where there are conditions for concentrated use of underground space, we shall specify the principles and target scale of underground space development, coordinate the relationship between aboveground and underground space, and promote the comprehensive utilization of underground space resources.

生态环境保护

Protection of ecosystem

对规划实施后可能造成的环境影响作出分析、预测和评价,提出减缓对策和措施。结合上位规划和相关专项规划确定生态系统格局,落实生态保护目标和任务;明确绿色建筑、新能源利用等方面的要求。

We shall analyze, forecast and evaluate the possible environmental impact after the implementation of the plan, and put forward mitigation measures. We shall determine the ecosystem pattern and implement the objectives and tasks of ecological protection in combination with the master plan and relevant special plans, and specify the requirements for green buildings and new energy utilization.

综合防灾系统

Comprehensive disaster prevention system

结合对灾害风险的评估,提出应对洪、涝、台风、地震等各类灾害的措施,划定疏散和紧急避难场所,提出明确建设韧性城市的各项要求。

We shall put forward measures to deal with various disasters such as flood, water-logging, typhoon and earthquake in combination with the assessment of disaster risks, formulate measures to deal with various disasters such as flood, water-logging, typhoon and earthquake, and delineate evacuation and emergency refuge places, and put forward various requirements for building resilient cities.

城市设计引导

Urban design guidance

单元规划明确区域风貌定位,开敞空间体系、建筑高度分区、确定门户、标志性建(构)筑物(群)、重要节点、重要边界(界面)、景观廊道等内容,划定城市设计重点地区;地块规划应落实城市设计管控要求,提出建筑形态、建筑界面、滨水岸线、景观设施、地下空间、建筑色彩等的管控要求,向地块建筑设计方案传导。
