为深入贯彻《海南省人民政府办公厅关于进一步加强矿业权管理的通知》(琼府办函〔2020〕351号)、《海南省绿色矿山建设工作实施方案》(琼国土资储字〔2017〕142号)、《自然资源部办公厅关于做好2020年度绿色矿山遴选工作的通知》(自然资办函〔2020〕839号),以及省厅2021年度重点工作部署,加快推进省级绿色矿山建设,促进建设国家级绿色矿山建设。现将有关事项通知如下:
In order to thoroughly implement the Circular of the General Office of the People's Government of Hainan Province on Further Strengthening the Management of Mining Rights(The General Office of Hainan Provincial People's Government-Circular - 2020-No. 351), theImplementation Plan for the Construction of Green Stone Mines in Hainan Province(Hainan DLER- Circular - 2017 -No. 142), theCircular of the General Office of the Department of Natural Resources and Planning of Hainan Provinceon the Selection of Green Stone Mines in 2020(Hainan DNRP Office- Circular - 2020-No. 839), and the key work arrangements of the Department of Natural Resources and Planning of Hainan Province in 2021, the provincial departmentwill accelerate the construction of provincial-levelgreen stone mines, and promote the construction of national green stone mines. The relevant matters are hereby notified as follows:
一、分类施策,加快推进绿色矿山建设
1. Adopting ClassifiedPolicies to SpeedUp the Construction of GreenStoneMines
(一)积极推动生产矿山改造升级,高质量建设绿色矿山。 生产矿山应采用绿色、环保、安全、高效的新技术、新装备、新工艺进行改造升级,对照绿色矿山建设规范或技术指南要求加快推进绿色矿山建设。各类矿山应严格按照开发利用方案、治理方案要求,做到规范生产、落实生态修复。针对目前我省露天开采石料矿山较多、绿色矿山建设任务繁重等实际,一是大力加强露天石料矿山自上而下台阶式开采的安全规范监管,全面采取2020年6月省厅在东方市召开绿色矿山现场观摩推进会所推介的矿山治理修复新技术、新措施,推进露天矿山终了区自上而下整体覆盖、快速推进的治理修复,真正做到边开发、边治理、边复绿;二是通过矿石加工场密闭改造、废渣过滤干排回收利用、喷雾抑尘等措施,严格扬尘、排废、噪音达标监管,加强主干运输道路和选矿加工及堆料场地硬化、矿区环境绿化、生活办公场所美化等基础建设;三是对不符合有关规范要求、不适应绿色矿山建设标准的开发利用方案、治理修复方案,必须按规定重新修编,办理审批等手续,并参照新建矿山的要求限期建成绿色矿山。
(1)The provincial departmentwill actively promote the transformation and upgrading of production mines, and develop high-quality green stone mines. In the production of mines, the provincial departmentshall adopt new technologies, equipment, and processes that are environmentally friendly, safe, and efficient for the transformation and upgrading, and the acceleration of the construction of green stone mines according to the green stone mine construction specifications or technical guidelines. All kinds of mines shall strictly comply with the requirements of development and utilization and treatment plans, so as to regulate production and implement ecological restoration. In view of the fact that there are many open-pit stone mines and heavy tasks of green stone mine construction in our province, first, the provincial departmentwill vigorously strengthen the safety regulation and supervision of top-down bench mining of open-pit stone mines, comprehensively adopt the new technologies and measures for mine treatment and restoration recommended by the green stone mine on-site observation and promotion conference held by the provincial department in Dongfang City in June 2020, and move forward with the comprehensive top-down coverage of the terminal areas of open-pit mines and the rapid treatment and restoration, so as to ensure governance and greening restoration at the same time of development. Second, the provincial department willadopt measures such as closed transformation of ore processing yards, waste residue filtration, dry drainage recovery and utilization, spray and dust suppression to strictly supervise the compliance of dust emissions, waste disposal and noise standards, and strengthen infrastructure construction such as main road transportation, mineral processing, concrete pavement of yards, environmental greening in mining areas, and the beautification of living and working places. Third, the provincial departmentwill revise the development and utilization plans and treatment and restoration plans that do not meet the requirements of relevant specifications and do not adapt to the green stone mine construction standards according to the regulations, go through the formalities of examination and approval, and build Green Stone Mines within a time limit according to the requirements of new mines.
各地应组织矿山企业对矿山保有资源储量、资源开发利用、矿山地质环境治理修复等情况进行系统分析,明确提出绿色矿山建设意愿,制定绿色矿山建设的工作计划、进度安排、基本措施等,并加强日常监督指导,加快落实绿色矿山建设。相关情况请于5月30日前报送省厅。
All localities shall organize mining enterprises to make systematic analysis of the reserves of resources in mines, the exploitation and utilization of resources, and the treatment and restoration of the geological environment of mines, clearly put forward the intention of green stone mine construction, formulate relevant work plans, schedules and basic measures, and strengthen daily supervision and guidance, so as to accelerate the implementation of green stone mine construction. Relevant information shall be submitted to theprovincial departmentbefore May 30.
(二)从严源头管控,限期落实新建矿山建设达标。 加强完善采矿权出让方案、出让合同、登记审批等管理,新立采矿权出让合同中必须明确开发方式、资源利用、矿山地质环境保护与治理修复、绿色矿山建设期限等相关要求及违约责任;严格执行新规定、新要求,所编制的开发利用与保护修复方案,应包含绿色矿山建设专章,通过审查审批并严格落实,经矿产资源行政主管部门核准后方可投产;投产一年后应建成绿色矿山,按照国家和省级绿色矿山评估认定工作安排要求,及时申报并通过绿色矿山认定。如未能通过绿色矿山认定的,应依法依规责令停产整顿,整顿通过验收核准后,才能实施生产。
(2)The provincial departmentwill strictly control the source and ensure that new mines meet construction standards within a specified period. The provincial department willstrengthen the management of mining rights transfer schemes, transfer contracts, registration and approval. Relevant requirements and liabilities for breach of contract in terms of development mode, resource utilization, mine geological environment protection, treatment and restoration, green stone mine construction period must be clearly defined in the newly established mining rights transfer contract. The provincial departmentwill strictly implement the new regulations and requirements. The prepared development, utilization, protection and restoration schemes shall include a special chapter on green stone mine construction, which shall be examined, approved and strictly implemented before it can be put into operation with the approval of the administrative department of mineral resources. A green stone mine shall be established one year after it is put into operation, and shall be declared and approved in a timely manner in accordance with the requirements of national and provincial green stone mine assessments and accreditation arrangements. If the mine fails to pass the accreditation of green stone mine, it shall be ordered to stop production for rectification in accordance with the law and regulations, and only after the rectification has passed the acceptance inspection and approval can it start production.
二、加强绿色矿山申报、评审和认定管理
2. Strengthening the Management of Application,Review and Accreditation of Green Stone Mines
分步推动省级、国家级绿色矿山建设,落实绿色矿山建设的企业自主评价,申报绿色矿山的企业按规范要求编制的自评报告。省厅根据企业申请及工作需要,分批组织第三方评估、现场核查、专题审查、通过公示等符合规定要求的,分批认定省级绿色矿山,及时按规定推荐申报国家级绿色矿山。
The provincial departmentwill promote the construction of Green Stone Mines at provincial and national levels step by step, implement the independent evaluation of enterprises for the construction of Green Stone Mines, and prepare self-evaluation reports for enterprises applying for Green Stone Mines in accordance with the requirements of the regulations. According to the application and work needs of enterprises, the provincial department shall organize third-party evaluations, on-site inspections, special examinations and public announcements in batches to identify provincial-level Green Stone Mines, and timely recommend those that have been approved as provincial-level Green Stone Mines to apply to be national-level Green Stone Mines in accordance with regulations..
(一)申报基本条件。
(1) Basic conditions for application.
1.基本依据。按照《国土资源部关于加快建设绿色矿山的实施意见》(国土资规〔2017〕4号)、自然资源部矿产资源保护监督司《关于印发<绿色矿山评价指标>和<绿色矿山遴选第三方评估工作要求>的函》(自然资矿保函〔2020〕28号)、《海南省人民政府办公厅关于进一步加强矿业权管理的通知》(琼府办函〔2020〕351号)等文件要求,依据自然资源部公告发布的《非金属矿行业绿色矿山建设规范》等行业标准,以及我省发布的《海南省饮用天然矿泉水绿色矿山建设技术指南(试行)》《海南省地热水绿色矿山建设技术指南(试行)》等规范开展申报遴选。
1. Basic basis. Application and selection shall be carried out according to the document requirements of the Implementation Opinions of the Ministry of Land and Resources on Accelerating the Construction of Green Stone Mines(MLR - Regulation -2017-No. 4), the Issuance of the Circular of "Green Stone Mine Evaluation Indicators" and the "Requirements for Third-party Evaluation of Green Stone Mine Selection"by the Department of Mineral Resources Protection and Supervision of the Ministry of Natural Resources (TheDepartment of Mineral Resources Protection and Supervision ofMNR - Circular - 2020-No. 28), the Circularof the General Office of the People's Government of Hainan Province on Further Strengthening the Management of Mining Rights(The General Office of Hainan Provincial People's Government- Circular - 2020-No. 351), the industrial standards of the Green Stone Mine Construction Specification of Non-metallic Mineral Industryissued by the Ministry of Natural Resources, as well as the Technical Guide for the Construction of Green Stone Mines with Drinking Natural Mineral Water in Hainan Province (Trial), and the Technical Guide for the Construction of Green Stone Mines with Geothermal Water in Hainan Province (Trial)issued by Hainan Province.
2.申报范围。申报矿山应为持有有效采矿许可证且正常运营的独立矿山(包括油气矿产、固体矿产、水类矿产等),已依法取得环评、安全生产等审批手续,近三年内未受到中央环保督察、省委巡视责令整改,以及资规、生态环境、综合执法等部门行政处罚,或责令整改、受到行政处罚已整改到位并通过核查验收;
2. Scope of application. The declared mine shall be an independent mine (including oil and gas minerals, solid minerals, water minerals, etc.) with a valid mining license and normal operation, which has obtained approval procedures for environmental assessment and work safety according to the law, and has not been ordered to make rectification by the central environmental protection inspector and the provincial Party Committee for inspection in the past three years, and has not received administrative punishment from the departments of natural resources and planning, ecological environment and comprehensive law enforcement, or has been rectified in place and passed verification and acceptance after receiving the order of rectification and administrative punishment;
遴选期间,未被列入异常名录,不存在涉嫌违法行为;矿区范围未涉及各类自然保护地。 矿山新建投产未满一年、矿山保有可采储量不足三年,尚未建矿正常经营、处于停产状态的,不列入绿色矿山申报和评定范围。
During the selection period, it is not included in the abnormal list, and there is no suspected illegal behavior; the mining area does not involve various natural reserves. Where a newly built mine has been put into operation for less than one year, the mine has maintained recoverable reserves for less than three years, and has not yet been under normal operation or is in a state of suspension of production, it shall not be included in the scope of green stone mine application and evaluation.
(二)2021年度省级绿色矿山申报程序及期限要求。
(2) Provincial procedures and deadline requirements for green stone mine application in 2021.
1.矿山自评。各市县局组织辖区内符合申报条件的企业对照绿色矿山建设要求和行业标准开展自评,形成自评估报告,并在全国绿色矿山名录管理信息系统中填报。填报内容包括自评报告、绿色矿山名录入库信息表、展现矿山整体面貌的影像、图片资料等(第一批5月30日前,第二批11月30日前)。
1. Mine self-evaluation. The municipal and county bureaus shall organize the enterprises within their jurisdiction that meet the application conditions to carry out self-evaluation according to the construction requirements of Green Stone Mines and industrial standards, and form self-evaluation reports, which shall be filled out in the management information system of the national green stone mine directory. The contents to be filled include self-evaluation reports, entry information tables of the green stone mine directory, images and picture data showing the overall appearance of the mine, etc. (before May 30 for the first batch and before November 30 for the second batch).
2.第三方评估。由省厅按规定优选并委托第三方评估机构,对符合申报条件的企业绿色矿山建设情况进行实地核查,按照统一评价指标要求进行量化评分,形成第三方评估报告(第一批6月10日前,第二批12月10日前)。
2. Third-party evaluation. The provincial department shall select and entrust a third-party evaluation agency according to regulations to conduct on-site verification on the green stone mine construction of enterprises that meet the requirements of application, and perform quantitative scoring in accordance with the requirements of unified evaluation indicators to form a third-party evaluation report (before June 10 for the first batch and before December 10 for the second batch).
3.实地抽查。由省厅组织核查组审核绿色矿山名录入库信息表、第三方评估报告等各类材料,采取明察暗访、随机抽查、问卷调查等多种手段,对通过第三方评估的矿山开展实地抽查(第一批6月15日前,第二批12月15日前)。
3. On-site spot check. The provincial department shall organize the verification team to examine the entry information table of the green stone mine directory, third-party evaluation report and other materials, and carry out spot inspection on the mines that have passed third-party evaluation by various means, such as open and secret inspections, random sampling and questionnaire surveys (before June 15 for the first batch and before December 15 for the second batch).
4.专题审议。由省厅召开专题会审议,审核通过第三方评估、实地抽查的有关成果资料,确定拟选省级绿色矿山名录。(第一批6月20日前,第二批12月20日前)。
4. Thematic review. The provincial department shall hold a special meeting for the deliberation, examination and approval of the relevant results of the third-party evaluation and on-site spot check, and determine the directory of Green Stone Mines to be selected at the provincial level (before June 15 for the first batch and before December 20for the second batch).
5.公示。通过厅官网、报纸等渠道,公示通过专题会议审议的遴选结果。(第一批6月25日前,第二批12月25日前)。对通过公示的企业,正式纳入省级绿色矿山名录并进行公告。2021年度国家级绿色矿山申报程序及期限要求,按照国家有关规定执行,届时将另行通知。
5. Public Announcements. The provincial departmentwill publicize the selection results deliberated at the special meeting through the official website, newspapers and other channels (before June 25 for the first batch and before December 25 for the second batch). Enterprises that have passed the publicity shall be officially included in the provincial green stone mine directory and announced. The application procedures and deadline requirements for the 2021 national Green Stone Mines will be implemented in accordance with the relevant national regulations, and will be notified separately at that time.
三、加强绿色矿山名录动态管理
3. Strengthening the Dynamic Management of the Green Stone Mine Directory
加强矿山地质环境动态监测、矿业权人信息公示监管等日常管理,将矿山严格落实矿山规范开发及生态修复,严格做到环境保护,实现安全生产、绿色矿山建设等内容列入动态监测、信息公示监管的重要内容,严格日常监督管理。对按规定经抽查被列入异常名录的矿山,应责成限期整改;逾期不完成整改并通过核查的,取消绿色矿山资格。
The provincial departmentwill strengthen the daily management of dynamic monitoring of the mine geological environment and information publicity and supervision of mining rights holders; strictly implement the standard development and ecological restoration of mines; ensure information such as environmental protection, safe production and green stone mine construction included in the important contents of dynamic monitoring, information publicity and supervision; and strengthen daily supervision and management. Mines that have been included in the list of abnormalities through random inspection according to regulations shall be obliged to make rectification within a prescribed time limit; those that fail to complete the rectification and pass the verification within the time limit shall be disqualified from Green Stone Mines.
四、工作要求
4. Work Requirements
(一)高度重视,精心组织。各市县局要进一步提高责任意识,站在自贸区港建设要素保障的高度,积极担当作为,加强矿山企业日常监督管理,严格按照规定要求,督促指导矿山企业全力加快建设绿色矿山,推进绿色矿业发展。要周密部署、落实责任,从实际出发,遴选出符合要求的绿色矿山。省厅将适时召开现场推进会,推广典型经验,充分调动各方积极性。
(1)The provincial departmentwill attach great importance to it and organize it carefully. All municipal and county-levelbureaus shall further enhance their sense of responsibility, take active responsibilities and strengthen the daily supervision and management of mining enterprises, urge and guide mining enterprises to speed up the construction of Green Stone Mines in strict accordance with regulations and requirements, and promote the development of Green Stone Mines. The provincial departmentshall make careful arrangements, fulfillresponsibilities, and select Green Stone Mines that meet the requirements based on reality. The provincial department will timely hold on-site promotion meetings to promote the typical experience, and fully mobilize the enthusiasm of all sides.
(二)落实第三方评估机构的责任机制。遴选工作要严格标准、符合程序、实事求是,确保公开公平公正。要严格按照自然资矿保函〔2020〕28号文件和《绿色矿山遴选第三方评估工作要求》规范评估工作。要自觉遵守自然资办函〔2020〕839号文件明确的各项要求开展第三方评估工作,评估工作不得向企业收费。对存在弄虚作假,徇私舞弊等严重违规行为,将予以通报,不予采信其评估报告。
(2)The provincial department willimplement the accountability mechanism of the third-party assessment agency. The selection work shall be conducted in strict accordance with standards to ensure openness, fairness and impartiality. The evaluation work shall be regulated in strict accordance with the document [2020] No. 28 issued by theDepartment of Mineral Resources Protection and Supervision ofMinistry of Natural Resources and the Requirements for Third-party Evaluation of Green Stone Mine Selection. Third-party evaluations shall be carried out in accordance with the requirements specified in document No. 839 issued by theOffice ofDepartment of Natural Resources and Planning of Hainan Province(2020), and the evaluation feesshall not be chargedtothe enterprises. Serious violations such as fraud and malpractice for personal gain will be notified, and their evaluation reports will not be accepted.
(三)加强监督,严格管理。各地要做好日常监督管理,按照矿业权人信息公示管理要求,对已纳入绿色矿山名录的矿山进行抽查,发挥好社会监督作用,建立诚信体系。对发现不符合标准的矿山要及时上报,作出相应处理。
(3)The provincial departmentwill strengthen supervision and strict management. Local governments shall do a good job in daily supervision and management, carry out spot checks on mines that have been included in the directory of Green Stone Mines in accordance with the management requirements for information disclosure of mining rights holders, give full play to the role of social supervision and establish a credibility system. Those mines found not up to the standards shall be promptly reported and dealt with accordingly.
(四)及时填报材料。为减轻企业负担,减少材料报送,自评 报 告 等 材 料 均 在 全 国 绿 色 矿 山 名 录 管 理 信 息 系 统(http://greenmine.mnr.gov.cn/)中填报,无需报送纸质版。
(4)The provincial departmentwill fill in the materials in time. In order to reduce the burden on enterprises and material submission, materials such as self-evaluation reports can be filled out in the management information system of the national green stone mine directory (http://greenmine.mnr.gov.cn/), without the necessity of submitting a paper version.
请各市县局分别于5月30日、11月30日前组织本辖区矿山企业在系统中填报。
All municipal and county bureaus are requested to organize mining enterprises under their jurisdiction to fill in the reports on the system before May 30 and November 30, respectively.
