为贯彻落实《国务院关于深化“证照分离”改革进一步激发市场主体发展活力的通知》（国发〔2021〕7号）精神，深化自然资源和规划领域“证照分离”改革，进一步提高行政审批效率，现就有关事项通知如下：

In order to implementtheCircularon Deepening the Reformfor SeparatingOperating Permitsfrom Business Licensesin the Field of NaturalResources and Planningto Boost MarketDynamics(hereinafter referred to as the Circular)(State Council Gazette - 2021 - No. 7)and further improve the efficiency of administrative review and approval, relevant matters are hereby notified as follows:

1. 总体要求

1. 指导思想。以习近平新时代中国特色社会主义思想为指导，全面贯彻党的十九大和十九届二中、三中、四中、五中全会精神，持续深化“放管服”改革，统筹推进自然资源和规划领域行政审批制度改革，进一步优化营商环境、激发市场主体发展活力，促进海南自贸港建设。

1. Guidingideology

Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we must carry out the spirit of the 19th National Congress of the Communist Party of China, the second, third, fourth and fifth plenary meetings of the nineteenth Central Committee of CPC, continue to deepen the reforms to delegate powers, streamline administrations, improve regulations and optimize government services, promote the reform of the administrative review and approval system in the field of natural resources and planning, further improve the business environment, and boost market dynamics so as to accelerate the construction of Hainan Free Trade Port.

1. 改革目标。自2021年7月1日起，对自然资源和规划领域涉企经营许可事项实施全覆盖清单管理，按照直接取消审批、实行告知承诺、优化审批服务三种方式，对14项许可事项分类推进审批制度改革。

1. Aim of reform

Since July 1, 2021, a list management approach has been introduced, covering all business operations in the fields of natural resources and planning. Approval reforms have been advanced in 14 licensing items, including abolishing approval formalities, introducing letters of commitment and streamlining review and approval services.

1. 直接取消审批。

1. Abolishapprovalformalities

取消城乡规划编制单位丙级资质认定及地质灾害危险性评估、地质灾害治理工程勘查、地质灾害治理工程设计、地质灾害治理工程施工、地质灾害治理工程监理单位丙级资质审批6项审批。将其单位的资质由三级调整为两级，取消丙级资质，根据自然资源部新规定相应调整乙级资质的许可条件，修订发布政务服务指南。

Abolish six approval formalities. Cancel the reviewand approvalof the Class-C qualification of urban-rural planning institutions, the Class-C qualification of geological disaster risk assessment units, and the Class-C qualification of survey, design, supervision and construction units of geological disaster control projects.Adjust the qualification of its unit from Level-3 to Level-2, cancel the Class-C qualification, adjust the licensingconditions of the Class-B qualification based onthe new regulations of the Ministry of NaturalResourcesof China, and revise and distribute the government service guide.

（二）实行告知承诺。

(2) Introduce letter of commitment

对城乡规划编制单位乙级资质认定实行告知承诺方式审批。制订并公布告知承诺书格式文本，一次性告知申请人许可条件和所需材料，对申请人自愿承诺符合许可条件并按要求提交材料的，当场作出许可决定。对通过告知承诺取得许可的企业，有关主管部门要加强事中事后监管，确保有必要的可以开展全覆盖核查。发现企业不符合许可条件的，要依法调查处理，及时将企业履行承诺情况记入企业信用记录，推送至海南自由贸易港信用信息共享平台，依法依规实施失信惩戒。

Class-B qualification of urban-rural planning institutions shall be approved via letter of commitment.Formulate and publicizethe format text of the letter of notification and promise, and inform applicantsof the licensingconditions and required materials at one time.Issue licenses on the spotwhenapplicantsvoluntarily promise to meet the licensing conditions and submit materials as required.For the enterprises that have obtained the license vianotification and promise, relevant departments shall strengthen the supervision during and after the business operation, and carry out full-coveragereviewif necessary. Onceanenterpriseis found nottomeet the licensing conditions, it shall be investigated and dealt withaccording to thelaw. Meanwhile,the performance of the enterprise'spromisewillbe recorded in the enterprise's credit record in time, publishedinthe credit information sharing platform of Hainan FreeTradePort, and alsopunished for dishonesty according to relevantlawsandregulations.

（三）优化审批服务。

(3)Streamlinereview and approvalservices

1.精简地质灾害危险性评估单位乙级资质审批申请材料。根据自然资源部新规定，相应调整乙级资质的许可条件，修订发布政务服务指南，不再要求申请人提供设立单位批准文件、法定代表人和技术负责人简历、法定代表人任命和聘任文件、技术人员从事地质灾害防治技术工作5年以上证明文件等材料。

Ⅰ. Streamline the review and approval of application materials for the Class-B qualification of geological disaster risk assessment units. According to the new regulations of the Ministry of Natural Resourcesof China, adjust the licensing conditions for the Class-B qualification accordingly, revise and distribute the government service guide; besides, the following documents are no longer required for approval: the approval documents of the unit establishment, resumes of legal representatives and technical directors, letters of appointment of legal representative, and proofs of working experiences in geological disaster prevention and control technology for more than 5 years.

2.精简地质灾害治理工程勘查、地质灾害治理工程设计、地质灾害治理工程施工、地质灾害治理工程监理单位乙级资质审批4项涉企审批事项申请材料。根据自然资源部新规定相应调整乙级资质的许可条件，修订发布政务服务指南，不再要求申请人提供设立单位批准文件、法定代表人和技术负责人简历、法定代表人任命和聘任文件等材料。

Ⅱ. Simplify the application materials for geological disaster control engineering exploration, geological disaster control engineering design, geological disaster control engineering construction, and the Class-B qualification approval of geological disaster control engineering supervision units. According to the new regulations of the Ministry of Natural Resourcesof China, adjust the licensing conditions of the Class-B qualification accordingly, and revise and distribute the government service guide; meanwhile, the following documents are no longer required for approval: the approval documents of the unit establishment, resumes of legal representatives and technical directors, letters of appointment of legal representatives.

3.精简探矿权许可、采矿权许可2项涉企审批事项申请材料。在海南省人民政府令第286号已将探矿权许可、采矿权许可审批事项委托洋浦经济开发区管委会以及海口市、三亚市自然资源和规划主管部门实施的基础上，修订发布政务服务指南，不再要求申请人提供符合国家限制及政策调控申请条件等材料。

Ⅲ. Streamline the application materials for exploration permits and mining licenses. In accordance with Decree No. 286 of the People's Government of Hainan Province, the People's Government of Hainan Provincehas delegated the power for the approval of its exploration permits and mining licenses to the Administration Committee of Yangpu Economic Development Zone and the Departments/Bureaus of Natural Resources and Planning of Haikou and Sanya, and has revised and distributed the government service guide, without the requirement of providing materials such as supporting documents that are in line with national policies.

三、保障及配套措施

1. 加强组织领导，确保改革落地生效。开展“证照分离”改革是深化“放管服”改革、优化营商改革的重要举措，厅机关相关处室局、各市县自然资源和规划主管部门、有关单位要切实加强领导，明确职责分工，改造升级审批系统，细化工作措施，落实有关工作要求。海口市及三亚市自然资源和规划主管部门、洋浦经济开发区管委会要按照国发〔2021〕7号文件精神和本通知要求，组织对海南省人民政府令第286号已委托实施的14项许可事项，调整业务流程，修订完善工作规则和政务服务指南，推广电子证照应用，确保改革全面落地生效、企业充分享受改革红利。

(1) Strengthen organizational leadership to ensure the effective implementation of reform. Carrying out the reform for separating operating permits from business licenses helps to further delegate powers, streamline administrations, improve regulations and optimize government services, and perfect the business reform. The relevant bureaus and units, the Departments/Bureaus of Natural Resources and Planning of cities and counties of Hainan Provinceshould strengthen leadership, clarify the division of responsibilities, transform and upgrade the review and approval system, refine work measures, and implement specific work requirements.In accordance with the requirements of the Circular,the Departments/Bureaus of Natural Resources and Planning of Haikou and Sanya, along with the Administration Committee of Yangpu Economic Development Zone, shall implement the 14 licensing items issued by Decree No. 286 of People's Government of Hainan Province, adjust business processes, revise and improve work rules and the government service guide, and promote the application of e-licenses, so as to make sure that the reform is effectively implemented and enterprises fully enjoy the dividends of the reform.

1. 明确监管责任，完善监管方法。厅机关相关处室局、各市县自然资源和规划主管部门、有关单位要落实放管结合、并重要求，按照“谁审批、谁监管，谁主管、谁监管”原则，由审批部门依法承担监管职责、查处无证经营行为。全面推行“双随机、一公开”监管，发现违法违规行为要依法查处并公开结果。强化信用监管作用，向社会公布企业信用状况，依法依规构建黑名单制度，并对失信主体开展失信惩戒，充分发挥行业自律作用。

(2) Clarify regulatory responsibilities and improve regulatory methods.The Departments/Bureaus of Natural Resources and Planning of cities and counties of Hainan Provinceas well as relevant units shall delegate more powers to lower-level governments and to society while improving regulation, and strictly comply with the requirements. Furthermore, adhering to the principle of "whoever grants approval or is in charge shall conduct supervision", the department of review and approval shall shoulder the responsibility of supervision and deal with unlicensed business activities according to the law. In addition to the comprehensive implementation of the supervision of"random inspection and public release", violations shall be investigated and dealt with according to the law and the results disclosed to the public; besides, strengthen the credit supervisionthrough the credit system, expose the credit status of enterprises to the public, introducea blacklist administrative approach according to relevant laws and regulations, and punish those who breach the public trust, so as to give full play to the industries in self-discipline.

（三）做好宣传引导。厅机关相关处室局、各市县自然资源和规划主管部门、有关单位要做好“证照分离”改革宣传和政策培训解读工作，增强市场经营主体对改革的知晓度，进一步优化营商环境，增强市场经营主体获得感。

(3) Rev up publicity and guidance of the reform. The Departments/Bureaus of Natural Resources and Planning of cities and counties of Hainan Provinceas well as the relevant bureaus and units shall publicize the reform for separating operating permits from business licensesand conduct policy training, so as to enhance the awareness of market players about the reform, further improve the business environment, and boost the sense of gaining of market players.
