2021年3月31日，海南省自然资源和规划厅印发了《海南省自然资源和规划厅关于做好2021年度省级绿色矿山建设工作的通知》（琼自然资函〔2021〕618号，以下简称《通知》），现解读如下：

为推进矿业高质量绿色发展，加快矿业转型升级，国土资源部等六部委2017年3月22日联合印发了《关于加快建设绿色矿山的实施意见》（国土资规〔2017〕4号），2018年6月22日自然资源部发布了《非金属矿行业绿色矿山建设规范》等9项行业标准，2020年6月1日印发了《绿色矿山评价指标》和《绿色矿山遴选第三方评估工作要求》。2020年11月28日出台《海南省人民政府办公厅关于进一步加强矿业权管理的通知》（琼府办函〔2020〕351号），对我省绿色矿山建设及监管提出具体要求，为贯彻落实国家和省政府工作部署，制定印发本《通知》。

按照省委《关于进一步加强生态文明建设谱写美丽中国海南篇章的决定》（琼发〔2017〕25号），省政府《关于进一步加强矿业权管理的通知》决策部署，加快推进我省绿色矿山建设，逐步建成一批省级绿色矿山，促进建设国家级绿色矿山。

《通知》的明确的重要举措主要有：

  1. 分类推动绿色矿山建设。对于生产矿山，严格执行开发利用方案、治理方案，对照绿色矿山建设规范或技术指南要求进行改造升级，及时建成绿色矿山。对于新建矿山，通过完善采矿权出让方案、出让合同、登记审批等措施，严格按照绿色矿山建设标准，限期新建矿山投产一年后应建成绿色矿山。

(1)ClassifyGreen Stone Mines. 《通知》共分四部分：主要内容有：

  1. 分类施策，加快推进绿色矿山建设。一是积极推动生产矿山改造升级，高质量建设绿色矿山。通过加强露天石料矿山自上而下台阶式开采的安全规范监管，加强矿山环境保护措施落实、监管和矿山环境的绿化美化建设，对不符合有关规范要求、不适应绿色矿山建设标准的开发利用方案、治理修复方案按规定重新修编等措施指导生产各类矿山应严格执行开发利用方案、治理方案，并对照绿色矿山建设规范或技术指南要求加快推进绿色矿山建设。二是明确了新出让采矿权的矿山在投产一年后应建成绿色矿山。

  1. 加强绿色矿山申报、评审和认定管理工作。《通知》明确分步推动省级、国家级绿色矿山建设，明确了省级绿色矿山的申报的基本依据和范围、2021年度省级绿色矿山申报程序及期限要求，落实绿色矿山建设的企业自主评价，申报绿色矿山的企业按规范要求编制的自评报告。省厅根据企业申请及工作需要，分批组织第三方评估、现场核查、专题审查、通过公示等符合规定要求的，分批认定省级绿色矿山，并及时按规定推荐申报国家级绿色矿山。

  1. 加强绿色矿山名录动态管理。将绿色矿山建设内容列入加强矿山地质环境动态监测、矿业权人信息公示监管等日常管理，对按规定经抽查被列入异常名录的矿山，应责成限期整改；逾期不完成整改并通过核查的，取消绿色矿山资格。

（四）明确了做好省级绿色矿山建设工作的四项具体要求。明确了第三方评估机构的责任机制，明确了矿山企业填报资料的方式和时间。

五、权限范围

5. Scope

省级绿色矿山建设工作由省自然资源和规划厅牵头，根据企业申请及工作需要，在矿山企业自评的基础上组织第三方评估、现场核查、专题审查、公示等工作，认定省级绿色矿山；对符合规定的及时推荐申报国家级绿色矿山。各市县局要加强督促指导本辖区矿山企业加快建设绿色矿山，并分别于5月30日、11月30日前组织本辖区矿山企业在全国绿色矿山名录管理信息系统中填报。

  1. 新出让采矿权应在采矿权出让方案、出让合同、登记审批等环节明确绿色矿山建设期限相关要求及违约责任；所编制的开发利用与保护修复方案，应包含绿色矿山建设专章；投产一年后应建成绿色矿山，并按照绿色矿山评估认定工作要求，及时申报并通过绿色矿山认定，如未能通过绿色矿山认定的，应依法依规限期整改，整顿通过验收核准后，才能实施生产。

（二）2021年省级绿色矿山的认定分二批组织，分别为上、下半年的5月30日、11月30日前，矿山企业将自评报告等材料均在全国绿色矿山名录管理信息系统中填报，而后由省厅按程序组织认定工作。

七、关键词诠释

绿色矿山是指在矿产资源开发全过程中，实施科学有序开采，对矿区及周边生态环境扰动控制在可控制范围内，实现环境生态化、开采方式科学化、资源利用高效化、管理信息数字化、和矿区社区和谐化的矿山。主要建设依据为2018年6月22日自然资源部发布了《非金属矿行业绿色矿山建设规范》等9项行业标准和2019年7月我省发布的《海南省饮用天然矿泉水绿色矿山建设技术指南（试行）》《海南省地热水绿色矿山建设技术指南（试行）》。

八、惠民利民措施

8. Beneficial Measures

（一）减轻矿山企业负担，减少材料报送，矿山企业编制的自评报告等材料均在全国绿色矿山名录管理信息系统（http://greenmine.mnr.gov.cn/）中填报，无需报送纸质版。

(1) In order to reduce the burden on enterprises and material submission, materials such as self-evaluation reports can be filled out in the management information system of the national green stone mine directory (http://greenmine.mnr.gov.cn/), without the necessity of submitting a paper version.

（二）明确要求由省厅委托组织开展第三方评估工作，评估工作不得向企业收费。

(2) The provincial department shall select and entrust a third-party evaluation agency according to regulations. The evaluation feesshall not be chargedtothe enterprises.

（三）《通知》将2021年省级绿色矿山的认定工作分为上、下半年各组织一次，方便了矿山企业根据自身绿色矿山建设情况进行申请和填报材料，进一步提高了矿山企业建设绿色矿山的积极性。

九、新旧政策差异

（一）相比全国绿色矿山每年组织一次遴选工作，《通知》将2021年省级绿色矿山的认定工作分为上、下半年的各组织一次，并明确了相应工作的时间节点，更加有利于我省推进省级绿色矿山建设工作。

矿山评价指标>和<绿色矿山遴选第三方评估工作要求>的函》(自然资矿保函〔2020〕28号)，结合我省实际，制定了《海南省中小型石料绿色矿山建设评价指南（试行）》，可操作性更强。
