　近日，省自然资源和规划厅印发《关于深化自然资源和规划领域“证照分离”改革进一步激发市场主体发展活力的通知》（以下简称《通知》），自2021年7月1日起，对自然资源和规划领域涉企经营许可事项实施全覆盖清单管理，按照直接取消审批、实行告知承诺、优化审批服务三种方式，对14项许可事项分类推进审批制度改革，这是对党中央国务院关于深化“证照”改革进一步激发市场主体发展活力的有力贯彻落实，是对海南建设更高水平中国特色自由贸易港的夯实基础。

Recently, the Department of Natural Resources and Planning of Hainan has issuedtheCircular on Deepening the Reform for SeparatingOperatingPermits from Business Licensesin the Field of Natural Resources and Planning toBoostMarket Dynamics(hereinafter referred to as the Circular).From July 1, 2021, alist management approach has been introduced,covering all business operations in the fields of natural resources and planning. Approval reforms have been advanced in 14 licensing items, including abolishing approval formalities, introducing letters of commitment and streamlining review and approvalservices.It is an effective measure to deepen the “licenses” reform and further boostmarket dynamicsproposed by the CPC Central Committee; it can also lay a solid foundation for Hainan to build a higher-level free trade port with Chinese characteristics.

Background of the Circular

2021年6月，《国务院关于深化“证照分离”改革进一步激发市场主体发展活力的通知》正式印发，出台《通知》针对企业办事体验、优化营商环境、事中事后监管有着必不可少的重要性。

In June 2021,the Circularwas officially issuedand distributed, which is of great importance to improve government services, business environment and regulations during and after the operations.

《通知》主要内容之一

直接取消审批。取消城乡规划编制单位丙级资质认定、地质灾害危险性评估单位丙级资质审批、地质灾害治理工程勘查、设计、监理、施工单位丙级资质审批共6项审批。

The first key point of the Circular

Abolish six approval formalities. Cancel the reviewand approval of Class-C qualificationof urban-rural planning institutions,Class-C qualification of geological disaster risk assessment units, and Class-C qualifications of survey, design, supervision and construction units of geological disaster control projects.

《通知》主要内容之二

实行告知承诺。对城乡规划编制单位乙级资质认定实行告知承诺方式审批。制订并公布告知承诺书格式文本，一次性告知申请人许可条件和所需材料。对申请人自愿承诺符合许可条件并按要求提交材料的，当场作出许可决定。

The second key point of the Circular

Introduce letter of commitment.Class-B qualification will be granted to urban-rural planning institutions based on acknowledgement and letter of commitment.Formulate and notifythe format text of the letter of notification and promise, and inform applicants of the licensing conditions and required materials at one time. Issue licenses on the spot when applicants voluntarily promise to meet the licensing conditions and submit documentsas required.

《通知》主要内容之三

优化审批服务。精简地质灾害危险性评估单位乙级资质审批，不再要求申请人提供设立单位批准文件、法定代表人和技术负责人简历、法定代表人任命和聘任文件、技术人员从事地质灾害防治技术工作5年以上证明文件等材料；精简地质灾害治理工程勘查、设计、监理、施工单位乙级资质审批，不再要求申请人提供设立单位批准文件、法定代表人和技术负责人简历、法定代表人任命和聘任文件等材料；精简勘查矿产资源审批、开采矿产资源审批，不再要求申请提供符合国家限制及政策调控申请条件等材料。

The third key point of The Circular

Streamlinereviewand approval services. Streamline the reviewand approval of Class-B qualification of geological disaster risk assessment units, the following documents are no longer required for approval:approval documents of the unit establishment, resumes of legal representatives and technical directors, letters of appointmentof legal representatives, and proofs of working experiencesin geological disaster prevention and control technology for more than 5 years; streamline the reviewand approval of Class-B qualification of survey, design, supervision and construction units of geological disaster control projects, the following documents are no longer required for approval:approval documents of the unit establishment, resumes of legal representatives and technical directors, letters of appointmentof legal representatives; simplify the reviewand approval of exploration and mining of mineral resources, without the requirement of providing materials such as supporting documentsthat are in line with national policies.

我厅于2019年6月已通过省政府令形式将省级自然资源部门负责的勘查矿产资源审批权限、开采矿产资源审批权限委托至海口市、三亚市自然资源部门和洋浦经济开发区。

The fourth key point of The Circular

In June 2019, the Department of Natural Resources and Planning of Hainan, in the form of Decreeof People’s Government of Hainan Province, delegated its power of approving  exploration and mining of mineral resources to Yangpu Economic Development Zone, and the Departments of Natural Resources of Haikou and Sanya.

The fifth key point of The Circular
