海南省自然资源和规划厅日前印发《关于推行建设项目用地预审与选址意见书建设用地规划许可证电子证照的通知》（以下简称通知），现就《通知》相关内容解读如下：

On July 13, the Department of Natural Resources and Planning of Hainan Province issued the Circular on Introducing Pre-approval Review on Land Use and Site Selection and E-licensing for Construction Projects (hereinafter referred to asthe Circular).The "Circular"is now interpreted as follows：

根据《国务院关于加快推进全国一体化在线政务服务平台建设的指导意见》（国发〔2018〕27号）和《海南省工程建设项目审批制度改革工作领导小组办公室关于做好推广应用第一批电子证照有关工作的通知》（琼工改办函〔2021〕6号）有关要求，为进一步深化“放管服”改革，提升我省自然资源和规划政务服务效能，优化营商环境，我厅决定在建设工程规划许可证电子证照应用基础上，在全省范围内推行建设项目用地预审与选址意见书、建设用地规划许可证电子证照。

To further the reforms of streamlining administration and delegating powers, improving regulations and upgrading services, enhancing the service effectiveness, and optimizing the business environment, the Department of Natural Resources and Planningof Hainan Provincehas decided toimplement pre-approval review on land use,site selection and E-licensing for construction projects based on theGuidelines of the State Council on Accelerating the Construction of National Integrated Online Government Service Platform (State CouncilGazette - 2018- No. 27)andCircular of the Office of the Leading Group for the Reform of the ReviewandApproval of Construction Projects in Hainan Province in the Promotion and Application of the First Batch of E-licenses (Office of Conversion of Industrial Land- Circular - 2021- No. 6).

  1. Key Points

  1. 自2021年7月15日起，全省范围内全面启用建设项目用地预审与选址意见书、建设用地规划许可证电子证照，并实行全省统一编码，审批机关原则上不再发放纸质证照。审批机关颁发的电子证照带有审批机关电子签章，与纸质证照具有同等法律效力，可作为开展工作，办理后续政务服务事项的依据；

  1. From July 15, 2021, the department shall fully implement pre-approval review on land use andsite selection and E-licensing for construction projects across the entire province. Unified licensing numbers will be applied at the same time. In theory, review and approval authorities willnot issue paper permits thereafter. E-licenses with E-stamps will carry the same legal effects as paper versions, enabling construction institutions to get access to follow-up government services.

  1. 用地单位可通过海南工程建设项目审批管理系统（以下简称工建系统）向当地相应审批机关申请办理建设项目用地预审与选址意见书，审批机关在业务办结时同步生成电子证照。以划拨方式取得国有土地使用权的，由本地自然资源和规划主管部门核发国有土地划拨决定书，建设用地规划许可证审批部门经工建系统同步完成建设用地规划许可证电子证照签发；以出让方式取得国有土地使用权的，建设单位在签订国有建设用地使用权出让合同后，由自然资源和规划主管部门通知本地建设用地规划许可证审批部门经工建系统同步核发建设用地规划许可证电子证照；

Land users shall submit relevant materials for pre-approval review on land use and site selection through the Hainan Construction Project Approval System (hereinafter referred to as the"System").Authorities will conduct approval procedures and issueE-licenses online. For construction institutions that have been granted the rights to use state-owned land by allocation, local natural resources and planning authorities shallapprove their rights to use state-allocated land. Construction land approving authorities shall issue the E-licenses of using land for construction purposes through the System at the same time.If the state-owned land use rights are obtained by transferring, the natural resources and planning authorities shall notifylocal construction land approval departmentsto issue the E-licenses for construction projects simultaneously through the industrial construction system.

  1. 电子证照的照面信息包含建设项目基本信息、验证二维码、发证机构、单体信息、电子签章等信息。相关电子证照信息向社会公开，接受监督。任何单位、企业或个人伪造、篡改电子证书的一律无效，涉嫌犯罪的，将依法追究刑事责任。我省将按照电子证照标准逐步实行电子化，已取得的纸质证照在有效期内可继续使用。

The front page shall contain the basic information of the construction projects, verification QR codes, issuing agencies, individual building information, E-stamps, etc.Relevant E-license information will be made available online to the publicfor their supervision.E-licenses forged or tampered with by any institution, enterprise or individual shall be deemed invalid. If there are any suspicions of a crime, there will be an investigation for criminal responsibility in accordance with the law.

3.OtherRequirements

厅审批办有关负责人强调，各市、县、自治县级自然资源主管部门、行政审批局，洋浦经济开发区规划建设土地局、行政审批局，相关具有审批职能的园区（新区、开发区），各项目建设单位，要高度重视本次电子证照推行工作，认真贯彻《通知》精神，强化数据共享，落实管理职责，组织做好本辖区的工作，确保各项工作落实到位。

TheApproval Office of the Department of NaturalResource and Planningof Hainan Province called on theBureau of Natural Resources and Planningandadministrative review and approval authorityof each city, county, autonomous county, andYangpu Economic Development Zone; industrial parks (new areas and development zones) authorized with review and approval rights; and project construction institutionsto attach great importance to the implementation of e-licenses, seriously follow the requirements ofthe Circular, improve data-sharing and fulfill the responsibilities on managing the administrative areas to ensure the progress of various work.
