各市、县、自治县人民政府,洋浦经济开发区管委会:

The peoples governmentsof cities, countiesand autonomous countiesof Hainan Province, and the Administration Committee of Yangpu Economic Development Zone:

为加强我省商业服务业用地及混合用地上建设的商业、办公类建设项目管理[具体指《国土空间调查、规划、用途管制用地用海分类指南(试行)》明确的二级类中商务金融用地(0902)、其他商业服务业用地(0904)上建设的商业、办公类项目,以下简称商办类项目],遏制将上述项目变相改造为具备长期居住功能的“类住宅”建筑的行为,切实发挥公共设施基本功能,维护健康有序的房地产市场秩序,经省委、省政府同意,现提出如下意见:

In order to strengthen the management on the commercial and office construction projects built on land for commerce, service and multiple purposes in Hainan Province specifically referring to commercial and office projects built on commercial and financial land (0902) and other commercial service land (0904) in Class II specified in the Guidelines for the Classification of Land and Sea Use for Territorial Space Investigation, Planning and Use Control (Trial),(hereinafter referred to as "commercial and office projects"),curb the disguised transformation of the above projects into "quasi-housing" buildings with long-term residential functions, give full play to the basic functions of public facilities and maintain a sound and orderly real estate market, we hereby put forward the following opinions with the approval of the Provincial Party Committee and the Provincial Government:

一、规范建设项目土地出让要求

1. Standardizing Land Transfer Requirements for Construction Projects

市场主体应当严格按照批准的规划用途进行开发、建设、销售和使用,严禁擅自改变规划用途。进一步加强规划实施监督管理,严格规范规划调整和审查审批程序,坚决维护规划的严肃性和权威性。

Market entities shall strictly follow the approved planning of utilization for development, construction, sales and use, and it is strictly forbidden to change the planned uses without authorization. We will further strengthen the supervision and management of the implementation of plans, strictly standardize the procedures for their adjustment, review and approval, and resolutely safeguard their seriousness and authority.

自然资源和规划主管部门要依据经批准的控制性详细规划严格落实规划条件等要求,在土地供应时,应会同有关部门,明确规划条件、对赌条款等各项要求,并将其作为土地出让条件载入招拍挂交易文件。要加强土地出让合同、对赌协议签订和履约情况的跟踪监管。对未按照土地合同和对赌协议约定的条件进行建设的,要依法追究责任。

Natural resources and planning authorities shall strictly implement the planning conditions and other requirements according to the approved detailed regulatory plans. In the supply of land, they shall, in conjunction with the relevant departments, clarify the requirements such as planning conditions and terms of bidding, and record them as the conditions of land transfer in the bidding, auction and listing transaction documents. We will strengthen follow-up supervision over the signing and implementation of land transfer contracts and valuation adjustment mechanisms (VAMs). Those who fail to carry out construction according to the conditions stipulated in land contracts and VAMs shall be held accountable in accordance with the law.

二、严格建筑设计要求

2. Improving Architectural Design Requirements

建设项目在申请建设工程规划许可时,行政审批主管部门应严格按照土地用途及用地规划条件对设计方案进行审查。商办类项目建筑设计方案应当符合以下要求:

When applying for construction planning permission for a construction project, the administrative examination and approval authorities shall review the design scheme in strict accordance with the land use and planning conditions. The architectural design schemes of commercial and office projects shall meet the following requirements:

(一)平面功能标注不得出现“公寓”“卧室”“客厅”等住宅类功能描述。

(1) The description of residential functions such as "apartment", "bedroom" and "living room" shall not appear in the label of design schemes.

(二)建筑平面形体应规整,应采用公共走廊、公共卫生间方式布局,不得采用住宅套型设计形式。外立面应具有明显的公共建筑形态和特点。

(2) The building sketchup shall be in a regular shape; the layout of public corridors and public toilets shall be adopted, and the design form of residential suites shall not be used. The exterior facade shall have obvious public building forms and characteristics.

(三)盥洗室、卫生间、茶水间或饮水供应点、阳台(含露台)及各类型管井、烟道、风井等应集中设置(首层商铺除外)。阳台(含露台)、空中花园等应与公共走廊、电梯厅等公共空间相连,不得在套内设置。

(3) Lavatories, toilets, tea rooms or drinking water supply points, balconies (including terraces) and various types of tube wells, vents, air shafts, etc. shall be set up centrally (except for shops on the first floor). Balconies (including terraces) and hanging gardens shall be connected with public corridors, elevator halls and other public spaces, and shall not be installed in residential suites.

(四)不得预留、违规增设可作为住宅用途的排水、排污、排烟等管位(道)、孔洞。除集中设置的食堂以及商业用途项目作为餐饮功能使用的区域外,不得设置燃气设施和厨房,在设计方案中应明确予以注明。

(4) It is not allowed to reserve or illegally add pipe positions (channels) and holes that can be used for residential purposes such as drainage, sewage discharge, and smoke exhaust. Gas facilities and kitchens shall not be set up except for centralized canteens and areas used for catering functions in commercial projects, which shall be clearly indicated in the design schemes.

三、加强建设施工和竣工验收管理

3. Strengthening the Management of Construction and Completion-based Check and Acceptance

住房城乡建设主管部门要在图审、施工、联合验收等环节加强监督管理,督促建设、设计、施工(含精装修)等单位落实主体责任,不得弄虚作假,不得预留、违规增设可作为住宅用途配套设施的条件,不得违规增设结构梁、结构楼板、插层等。

The authorities of housing and urban-rural construction shall strengthen supervision and management in drawing review, construction, and joint acceptance, urge design and construction (including fine decoration) companies to implement their main responsibilities, which shall not resort to fraud, reserve or add conditions for supporting facilities that can be used for residential purposes in violation of regulations, or illegally add structural beams, structural floors, intercalated floors, etc.

建设单位应严格按照土地出让合同和核准的规划设计方案要求开发建设。设计单位应根据相关规范标准以及核准的规划设计方案要求,进行建筑单体设计和施工图设计。施工图审查机构应将建筑设计方案要求纳入图审内容,对施工图设计文件严格审查。建设工程质量安全监督机构要加强对项目的工程建设过程质量安全监管,重点加强建筑主体、承重结构和消防等方面监管,在办理项目竣工验收手续时,严格按照规定要求把关核验。行政审批主管部门应当严格按照规划条件和建设工程规划许可内容进行规划核实。

Construction companies shall develop and construct in strict accordance with the requirements of land transfer contracts and approved planning and design schemes. Design companies shall carry out the design of single buildings and construction drawings in accordance with relevant specifications and standards and the requirements of approved planning and design schemes. Institutions of construction drawing review shall incorporate the requirements of architectural design schemes into the content of drawing review and strictly review the construction drawing design documents. Institutions of construction project quality and safety supervision shall strengthen the supervision over the quality and safety of the project construction process, focusing on strengthening the supervision of the main body of the building, load-bearing structure and fire control, and check and verify in strict accordance with the provisions and requirements when handling the completion-based check and acceptance procedures of construction projects. The administrative examination and approval authorities shall conduct planning verification in strict accordance with the planning conditions and the contents of the planning permission for construction projects.

四、加强销售登记环节管理

4. Strengthening the Management of Sales Registration

行政审批主管部门要加强商办类项目房屋性质、最小销售面积等预售方案的审核把关,对不符合预售管理要求的,严禁发放预售许可证。商办类项目可产权分割销售最小单元建筑面积不得小于300平方米。

The administrative examination and approval authorities shall strengthen the review and control of the pre-sale schemes such as the nature of residential units and the minimum sales area of commercial projects, and strictly prohibit the issuance of pre-sale licenses for those that do not meet the requirements of pre-sale management. The minimum unit building area of commercial and office projects that can be sold separately by property rights shall not be less than 300 square meters.

房产部门要加强销售现场公示监管,督促开发企业在销售现场设立公示牌,向购房对象明示房屋的规划用途、土地使用年限、物业服务费、水电气费标准(按照商业标准收费)以及配套建设指标等情况,告知购房对象严格按照规划用途使用,不得擅自改变用途,并在认购书和购房合同中与购房对象明确约定,提醒买受人购买的产品非住宅性质。商办类项目在办理不动产登记环节不得按照住宅类房地产进行登记。

The real estate authorities shall strengthen the supervision on the on-site publicity of sales; urge developers to set up signs at sales sites; make clear to the purchasers the planned use of apartments, land use life, property service fees, standards of water, electricity and gas fees (in accordance with commercial standards) and supporting construction indicators; inform the purchasers to use the property in strict accordance with the planned purpose and not to change the purpose without authorization; and make a clear agreement with the purchasers in letters of intent and housing purchase contracts to remind them of the non-residential nature of properties they buy. Commercial and office projects shall not be registered as residential real estate in the process of real estate registration.

市场监管部门要规范商办类项目发布广告行为,加大对开发企业发布的销售广告、开展宣传等行为的检查力度。广告中不得出现将商办类项目宣传具有住宅功能等内容,对开发企业和中介机构发布的违法广告或虚假宣传行为依法予以查处。

  The market supervision authorities shall regulate the advertisingbehaviorof commercial and office projects, and intensify efforts in the inspection of sales advertising, publicity and other behaviorsof developers. Commercial and office projects shall not be promoted with residential functions in advertisements, and illegal advertisements or false publicity issued by developers and intermediaries shall be investigated and punished in accordance with the law.

五、切实履行监督检查职责

5. Earnestly Performing the Duties of Supervision and Inspection

自然资源和规划、住房城乡建设、行政审批、综合执法、市场监管等部门要加强联动,联合开展监督检查,依托海南省工程建设项目审批管理系统,将项目建设工程设计方案推送至图审、施工、竣工验收等审查审批业务,同时将建设项目全过程审批业务数据实时回流至省“多规合一”信息综合管理平台,实现项目建设全链条、全过程闭环监管。

  The authorities of natural resources and planning, housing and urban-rural construction, administrative approval, comprehensive law enforcement and market supervision shall strengthen coordinated efforts, jointly carry out supervision and inspection, and push the design schemes of project construction to the review and approval offices such as drawing review, construction and completion-based check and acceptance through the approval management system of construction projects in Hainan Province, . At the same time, the real-time sharing of processed data of construction projects in the whole process will provide timely feedback to the provincial comprehensive information management platform for integrated planning, so as to realize the closed-loop supervision on the whole chain and process of project construction.

各职能部门加强对商办类项目的日常巡查,对擅自修改设计方案、不按要求报审、不按施工图施工、虚假宣传违规销售等违法违规行为要依法依规查处,将失信信息纳入海南自由贸易港信用信息共享平台。

  All functional departments shall strengthen daily inspection on commercial and office projects, investigate and deal with violations of laws and regulations such as unauthorized modification of design schemes, failure to report for approval as required, failure to construct according to construction drawings, false publicity and illegal sales, and incorporate untrustworthy information onto the credit information sharing platform of the Hainan Free Trade Port.

六、其他要求

6. Other Requirements

各市县要认真贯彻本意见要求,落实主体责任,加强本市县域内出现的“类住宅”项目建设行为的监督管理,在招商引资过程中明确相关政策和要求,从源头制止建设“类住宅”项目违法违规行为,建立健全商办类项目管理长效机制。对《国土空间调查、规划、用途管制用地用海分类指南(试行)》明确的三级类中零售商业用地(090101)、批发市场用地(090102)的项目建筑设计方案参照本意见第二条规定执行,并严禁旅馆用地(090104)建设项目分割销售和不动产登记。

  Each county and city of the province shall earnestly implement the requirements of the Opinions, implement their main responsibilities, strengthen the supervision and management on the construction of "quasi-housing" projects in their respective administrative areas, clarify relevant policies and requirements in the process of attracting investment, stop illegal activities of the construction of "quasi-housing" projects from the source, and establish and improve the long-term management mechanism of commercial and office projects. The architectural design schemes for retail commercial land (090101) and wholesale market land (090102) in the three-level category specified in the Guidelines for the Classification of Land and Sea Use for Territorial Space Investigation, Planning and Use Control (Trial)shall be implemented according to the provisions of Article 2 of the Opinions. In addition, it is strictly prohibited to split construction projects on hotel land (090104) for sale and allow registration for such properties.

以康养、总部经济等之名建设的项目参照执行,坚决防止借康养、总部经济等之名圈地变相开发商品住宅。

  Projects built in the name of developing health care industry and headquarters economy shall be implemented according to the same requirements, and disguised development of commercial properties in the name of developing health care industry and headquarters economy shall be resolutely prevented.

本意见自印发之日起实施。市县政府已颁布类似文件,但与本意见不一致的,应执行本意见规定。本意见印发实施前已批未建的项目,不符合本意见要求的,应修改建筑设计方案,并重新核发规划、施工许可证;对在建未售的项目,从房型设计以及水、电、燃气配套等方面进行全面检查,发现建设行为违反本意见的,应责令整改,经相关部门联合验收通过后方可销售。

  The Opinions shall take effect as of the date of their issuance. If the municipal and county governments have issued similar documents but are inconsistent with the Opinions, the provisions of the Opinions shall prevail. If a project that has been approved but not yet constructed before the issuance and implementation of the Opinions does not meet the requirements of the Opinions, the architectural design scheme shall be revised and a new planning and construction permit shall be issued. For the projects under construction but not sold, comprehensive inspection shall be conducted from the aspects of house type design and water, electricity and gas supporting facilities. If the construction behavioris found to be in violation of the Opinions, it shall be ordered to make rectification, and can be sold only after passing the joint acceptance of relevant authorities.
