Circular on Introducing Pre-approval Review on Land Use and Site Selection and E-licensing for Construction Projects

各市、县、自治县自然资源和规划局、行政审批局，洋浦经济开发区规划建设土地局、行政审批局，相关具有审批职能的园区（新区、开发区），各项目建设单位：

为进一步深化“放管服”改革，提升我省自然资源和规划政务服务效能，优化营商环境，根据《国务院关于加快推进全国一体化在线政务服务平台建设的指导意见》（国发〔2018〕27号）和《海南省工程建设项目审批制度改革工作领导小组办公关于做好推广应用第一批电子证照有关工作的通知》（琼工改办函〔2021〕6号）有关要求，我厅决定在建设工程规划许可证电子证照应用基础上，在全省范围内推行建设项目用地预审与选址意见书、建设用地规划许可证电子证照。现就有关事项通知如下：

To further the reforms of streamlining administration and delegating powers, improving regulations and upgrading services, enhancing the service effectiveness, and optimizing the business environment, the Department of Natural Resources and Planning of Hainan Province has decided toimplement pre-approval review on land use, site selection and E-licensing for construction projects based on the Guidelines of the State Council on Accelerating the Construction of National Integrated Online Government Service Platform (State CouncilGazette - 2018- No. 27)andCircular of the Office of the Leading Group for the Reform of the ReviewandApproval of Construction Projects in Hainan Province in the Promotion and Application of the First Batch of E-licenses (Office of Conversion of Industrial Land- Circular - 2021- No. 6). Details of the circular are as follows:

一、全面启用电子证照

1. Full-scale Introduction of E-licenses

自2021年7月15日起，全省范围内全面启用建设项目用地预审与选址意见书、建设用地规划许可证电子证照，并实行全省统一编码，审批机关原则上不再发放纸质证照。审批机关颁发的电子证照带有审批机关电子签章，与纸质证照具有同等法律效力，可作为开展工作，办理后续政务服务事项的依据。除涉密项目及法律、行政法规规定的不得公开的内容外，原则上不再要求提交纸质证照。

From July 15^th, 2021, the department shall fully implement pre-approval review on land use and site selection and E-licensing for construction projects across the entire province. Unified licensing numbers will be applied at the same time. In theory, review and approval authorities will not issue paper permits thereafter. E-licenses with E-stamps will carry the same legal effects as paper versions, enabling construction institutions to get access to follow-up government services. Paper licenses are not needed except in cases including, but not limited to, projects containing confidential information or are prohibited from being disclosed based on laws and administrative regulations.

二、电子证照的签发和获取

2. Issuing and Obtaining of E-licenses

（一）建设项目用地预审与选址意见书电子证照。用地单位通过海南工程建设项目审批管理系统（以下简称工建系统）向当地相应审批机关申请办理建设项目用地预审与选址意见书，审批机关经工建系统受理开展审批，在业务办结时同步生成电子证照，加盖本单位行政审批专用章的电子签章，在线生成完成电子证照签发。用地单位可登录海南政务服务网（网址:https://wssp.hainan.gov.cn/）登录账号→用户中心→证件资料→电子证照→选择证照，进行自主下载和打印。

(1) Pre-approval Review on Land Use and Site Selection for E-licenses

Land users shall submit relevant materials for pre-approval review on land use and site selection through the Hainan Construction Project Approval System (hereinafter referred to as “System”). Authorities will conduct approval procedures by stamping E-licenses with their official E-seal(s) and issuing E-licenses online. Construction institutions can download and print E-licenses through the Hainan Government Service Network (https://wssp.hainan.gov.cn/) by the following steps: account login → user’s center → certificates → E-licenses → downloading and printing E-licenses.

（二）建设用地规划许可证电子证照。以划拨方式取得国有土地使用权的，各市县、洋浦经济开发区自然资源和规划主管部门在受理划拨供地审批后，应指导申请人通过工建系统提交建设用地规划许可申请。划拨供地经各市县人民政府、洋浦经济开发区管委会批准后，由本地自然资源和规划主管部门核发国有土地划拨决定书，建设用地规划许可证审批部门经工建系统同步完成建设用地规划许可证电子证照签发。

(2) E-licensing for Construction Projects.

For construction institutions that have been granted the rights to use state-owned land by allocation, local (municipal, county-level and Yangpu Economic Development Zone) natural resources and planning authorities shall instruct construction institutions application procedures in the System, and issue the State-Owned Land Allocation Decision after the people’s government of localities (including the Administrative Committee of Yangpu Economic Development Zone) approve their rights to use state-allocated land. Construction land approving authorities shall issue the E-licenses of using land for construction purposes through the System at the same time.

以出让方式取得国有土地使用权的，各市县、洋浦经济开发区自然资源和规划主管部门依据规划条件编制土地出让方案，经市县人民政府、洋浦经济开发区管委会批准后组织土地供应，将规划条件纳入国有建设用地使用权出让合同。建设单位在签订国有建设用地使用权出让合同后，由自然资源和规划主管部门通知本地建设用地规划许可证审批部门经工建系统同步核发建设用地规划许可证电子证照。用地单位可登录海南政务服务网（网址:https://wssp.hainan.gov.cn/）登录账号→用户中心→证件资料→电子证照→选择证照，进行自主下载和打印。

If the state-owned land use rights are obtained by transferring, the natural resources and planning authorities of cities, counties or Yangpu Economic Development Zone shall prepare the land transferring scheme based on the planning, supply the land after being approved by the people's government of respective cities, counties or the Administration Committee of Yangpu Economic Development Zone, and incorporate the planning into the state-owned construction land use rights transferring contract. After the contract is signed, the natural resources and planning authorities shall notify the local construction land approval department to issue the E-licenses for construction projects simultaneously through the industrial construction system. Construction institutions can download and print E-licenses through the Hainan Government Service Network (https://wssp.hainan.gov.cn/) by the following steps: account login → user’s center → certificates → E-licenses → choosing your own licenses.

三、电子证照使用规则

3. Rules for Using E-licenses

（一）电子证照样式和内容。电子证照采用PDF格式文件为载体，加盖市县、洋浦经济开发区审批部门行政审批专用章电子签章，同时配套生成证照二维码，证照尺寸规格为A4（正页横版、附件竖版），电子证照不设正副本。电子证照的照面信息包含建设项目基本信息、验证二维码、发证机构、单体信息、电子签章等信息。

(1) E-license Content and Specifications

E-licenses shall use PDF file format certified with E-stamps of administrative review and approval authorities of cities, counties or Yangpu Economic Development Zone. QR codes for the licenses will be generated at the same time. The size of the E-license shall be A4 (landscape orientation for the license page and portrait orientation for attachments). E-licenses will not follow the traditional original-copy scheme. The front page shall contain the basic information of the construction projects, verification QR codes, issuing agencies, individual building information, E-stamps, etc.

（二）证照应用。在海南政务服务网办理各项业务，如需提供建设项目用地预审与选址意见书、建设用地规划许可证作为申请材料的，可在上传材料页面“填报材料”→“证照库”→“新电子证照库”→勾选要引用的证照，点击“引用”，即可调用。

(2) The Application of E-licenses

Construction institutions can use their E-licenses when applying on the Hainan Government Service Network for services requiring E-licenses of pre-approval review on land use and site selection for construction projects through the following steps: supporting materials→ license library → E-licenses→ tick the E-license you need → application.

（三）证照信息公开。相关电子证照信息向社会公开，接受监督。公众可通过扫描电子证照上二维码查验，实时证照信息，也可以登录海南省政务服务网的“工改首页→“证照公示”→搜索相关证号进行查询。

(3) Public Access to E-licenses.

Relevant E-license information will be made available online to the public. The public can verify the E-licenses by scanning the QR code or by searching the E-licenses on the Hainan Government Service Network through: home page of converted industrial land → E-licenses→ search by license number(s)

（四）证照监管。任何单位、企业或个人伪造、篡改电子证书的一律无效，涉嫌犯罪的，将依法追究刑事责任。

(4) Regulation of E-licenses

E-licenses forged or tampered with by any institution, enterprise or individual shall be deemed invalid. If there are any suspicions of a crime, there will be an investigation for criminal responsibility in accordance with the law.

四、做好与纸质证照的衔接工作

4. Transition from Paper Licenses to E-lisences

按照“应上尽上”原则，对在有效期内的纸质证照信息进行检查和清理，按照电子证照标准逐步实行电子化。已取得的纸质证照在有效期内可继续使用。对尚未统一换发电子证照的项目，先补录生成电子证照，再申请办理换发、延期等申报事项。

Paper licenses within the validity period can still be used, but will be screened, and all valid ones will be digitized following the e-licenses standards and made accessible online. Projects having yet to obtain an electronic version of their paper license can first register for an E-license and then apply for a replacement, extension or other reporting matters.

五、其他事项

5. Others

（一）强化数据共享。推进电子证照全流程自动推送，加强工建系统与省“多规合一”信息综合管理平台、省建设用地使用权和矿业权网上交易系统等政务系统间的互联互通，实现审批结果数据回流、信息实时共享互用，确保项目建设管理行为可追溯、可查询。

(1) Enhancing Data Sharing

Efforts need to be made to promote the automated sharing of E-licenses, enhance data sharing among the industrial construction systems with the “Multiple into One” Hainan Government Service Systems, for instance, the Comprehensive Information Management Platform for Integrated Planning and the Online Trading System of Construction Land Use Rights and Mining Rights, in order to realize the feedback of approval results and real-time data sharing, as well as to ensure that the project construction management behavior is traceable and verifiable.

（二）项目红线提交要求。申报人在办理建设项目用地预审与选址意见书、建设用地规划许可证时，应当上传建设项目用地范围红线坐标文件，数据格式须采用SHP压缩包格式、DXF格式或CSV界址点坐标表三种之一。坐标文件须使用2000国家大地坐标系，具体参照《国土资源部 国家测绘地理信息局关于加快使用 2000国家大地坐标系的通知》（国土资发〔2017〕30号）和《海南省测绘地理信息局关于启用海南地方相对独立平面坐标系的通知》（琼测国〔2020〕1号）。

(2) Submission Requirements for Red-Line Drawings of Construction Project Land

When applying for pre-approval review on land use and site selection and E-licenses for construction projects, applicants shall submit Red-Line coordinates of construction land using a supported file format (SHP, DXF or CSV) . Reference could be made from the following two documents: the Circularof the National Bureau of Surveying, Mapping and Geographic Information of the Ministry of Land and Resources on Accelerating the Use of the 2000 National Geodetic Coordinate System(MLR - Circular - 2017-No. 30) and the Circular of Hainan Provincial Bureau of Surveying, Mapping and Geographic Information on Implementing the Local Relatively Independent Coordinate System in Hainan(Bureau of Surveying, Mapping and Geographic Information- Circular-2020-No. 1).
